On December 4, 2012 police were called to Nicollet Mall in downtown Minneapolis after a report that a man had been harassing a woman there. Two Metro Transit police officers Jason Malland and Adam Marvin found 21 year old Wesley Rogers visibly intoxicated and decided to take him home so he can get some sleep and sober up on his own, instead of taking him to a detox facility. During the pat down the officers reportedly found an open bottle of liquor on the suspect, but failed to find a loaded .38 revolver behind his belt.
