History books are full of wacky and weird stories about the peculiar people who shaped the world. Although it's not all fun and games, some historical events are great for a laugh. If those who fail to remember history are doomed to repeat it, then hopefully there are still more comedic moments to come. Here is a list of five funniest wartime events of the 20th century. Wartime Doesn't Mean Sacrificing Tea Time The British are notorious for their love of tea. The UK Tea Council estimates that two-thirds of British citizens drink at least one cup of tea every day. Britain is the second largest tea-drinking nation per capita after the Republic of Ireland. This has been fairly evident since the 1700s when the Boston Tea Party took place. Further evidence of the UK's love of tea came at the end of the Second World War. Since 1945, British tanks have featured a tea-making apparatus as a permanent installation. Now, British soldiers can serve tea and their country at the same time. WWII Navy Crew Pledges To Serve and Embarrass The USS William D. Porter (http://ift.tt/1fH5kS0) was a WWII-era Destroyer vessel whose crew proved about as competent as the Three Stooges. Its first escort mission, in 1943, was to accompany the USS Iowa to Iran. The Iowa was carrying President Franklin D. Roosevelt, his secretary of state and several high-ranking politicians to a meeting with Churchill and Stalin. Mere days later, the crew somehow forgot to replace live depth charges with dummy charges for a training exercise. On November 12, a fully operational charge rolled off the deck, fell into the Atlantic and exploded. The crew assumed they were under attack. Naturally, the captain and his crew felt a little nervous even after the confusion was sorted out. So the ship's captain initiated a training exercise involving the Porter firing dummy torpedoes on the Iowa. On their third volley, the Porter's crew realized that they had just fired a live torpedo at the President of the United States. Luckily, the Iowa was able to make a quick turn and the torpedo missed the boat. The Porter came to its end during the Battle of Okinawa in 1945 when a kamikaze plane exploded in the water underneath it. Monty Python Boosts Morale For Doomed Sailors The HMS Sheffield was a Destroyer in the British Royal Navy that was deployed during the Falklands War. The Sheffield suffered a missile hit on May 4, 1982. A fire broke out and the crew was unable to contain it. From May 4 to May 10, the crew performed five inspections to see what they could salvage. While waiting to be rescued, the crew performed a rendition of "Always Look on the Bright Side of Life" from Monty Python's Life of Brian, led by Sub Lieutenant Carrington-Wood. The vessel sank on May 10, 1982, with twenty people on board. Silent But Deadly Threat For Pilots The aircraft technology used during the Second World War was a significant improvement from the planes that were popular in 1915. However, there were still major safety issues that needed to be worked out. For instance, Canadian pilot Edward M. Cooke recalls medical professionals informing the pilots about the dangers of gas. The story goes that gas buildup during descent could result in severe abdominal pain and thus the pilots were advised to get rid of gas as often as necessary. Pilot Robert Kirkpatrick highlights an additional challenge of managing such conditions while being fed a military-style meal consisting of large servings of Brussels sprouts. Vietnam War Colonel Gets a Surprise During the Vietnam War, a group of American soldiers was dropped into Cambodia on a mission to locate an enemy supply base known to be in the area. A five-day search uncovered nothing. Angry at the thought of having wasted five days, the team leader and his platoon expanded their search and came across a shiny red bicycle. As they were in a free-fire zone, the team leader took the bicycle since it likely belonged to a Viet Cong scout. The platoon waited for hours for the scout to appear, but he didn't show up. Finally, the team leader took the bicycle and ordered an extraction. The radio dispatcher asked if the team had found the supply base. The team leader replied, "no, but we are bringing back a new bicycle". The radio dispatcher was astounded and asked the team to hold position, as air support would arrive in minutes. Sure enough, massive air support arrived. A colonel in a helicopter saw the bicycle and asked, "What on earth is that"? The team leader replied, "this is the bicycle you wanted". As it turns out, the radio dispatcher was using an old codebook in which "new bicycle" meant "enemy general". http://ift.tt/1SW7w9M

5 Funniest Wartime Events of the 20th Century

By: jironde on: 9:51 AM
An unmanned SpaceX rocket has exploded less than three minutes after liftoff from Cape Canaveral in Florida, in the first major disaster for the company headed by internet tycoon Elon Musk. Skies were sunny and clear for the 10:21am (local time) launch of the gleaming white Falcon 9 rocket that was meant to propel the Dragon cargo ship to the International Space Station on a routine supply mission, the seventh for SpaceX so far. But two minutes, 19 seconds into the flight, contact was lost. Live television images from SpaceX's webcast and NASA television showed a huge puff of smoke billowing outward, then tiny bits of the rocket falling like confetti against a backdrop of blue sky. "The vehicle has broken up," NASA commentator George Diller said. "At this point it is not clear to the launch team exactly what happened." Mr Musk said the Falcon 9 "experienced a problem shortly before first stage shutdown", referring to the stage of rocket flight before the cargo ship would have been able to separate from the first stage of the rocket and reach orbit. "Will provide more info as soon as we review the data," he wrote on Twitter. Mr Musk's California-based company has led a series of successful launches even as competitor Orbital Sciences lost one of its rockets in an explosion in October, and a Russian Progress supply ship was lost in April. The Dragon cargo ship was carrying 1,800 kilograms of gear to the space station, including a large parking space, known as an international docking adaptor, designed to make it easier for an array of commercial crew spacecraft to dock at the orbiting lab in the future. "Very sorry to see @SpaceX launch failure. Serious ramifications for Space Station resupply. Good thing it's international," Canadian astronaut Chris Hadfield wrote on Twitter. After liftoff, SpaceX had planned to make a third try at a controlled, upright landing of its Falcon 9 rocket on an ocean platform with the goal of one day making rockets as reusable as airplanes.

"It is not our job to protect the people from the consequences of their political choices," Chief Justice John Roberts observed three years ago in National Federation of Independent Business v. Sebelius, the case that is usually described-with a good deal of imprecision-as having "upheld" ObamaCare. Did the chief justice mean what he said? Today the court delivered another ObamaCare ruling, this time entirely in the administration's favor and by a vote of 6-3. Unlike in NFIB, the majority in King v. Burwell spoke with a single voice, Roberts's. So did the dissenters, that of Justice Antonin Scalia. As Scalia sums it up: "The Court holds that when the Patient Protection and Affordable Care Act says 'Exchange established by the State' it means 'Exchange established by the State or the Federal Government.' That is of course quite absurd." The practical consequence is that despite the limiting language, tax subsidies will continue to flow to people who buy medical-insurance policies in the majority of states, which have not established exchanges. The justices went further in the administration's favor than the Fourth U.S. Circuit Court of Appeals, whose judgment they upheld. As Roberts explains (citations omitted here and in subsequent quotes): "The Fourth Circuit viewed the Act as 'ambiguous and subject to at least two different interpretations.' The court therefore deferred to the IRS's interpretation"-a doctrine known as Chevron deference. In a similar case called Halbig v. Burwell, the U.S. Circuit Court of Appeals for the District of Columbia had ruled that the statute was not ambiguous-that the provision limiting subsidies to policies purchased through "an Exchange established by the State" did in fact limit subsidies to policies purchased through "an Exchange established by the State." As Scalia observes: You would think the answer would be obvious-so obvious there would hardly be a need for the Supreme Court to hear a case about it. . . . Words no longer have meaning if an Exchange that is not established by a State is "established by the State." We hope Scalia pantomimed that last sentence while reading his dissent from the bench, just in case the conclusion is true. The majority, meanwhile, engages in a lengthy analysis of the language of various parts of the statute, which the chief justice sums up as follows: The upshot of all this is that the phrase "an Exchange established by the State under " is properly viewed as ambiguous. The phrase may be limited in its reach to State Exchanges. But it is also possible that the phrase refers to all Exchanges-both State and Federal-at least for purposes of the tax credits. But the majority rejects the Fourth Circuit's application of Chevron deference, which would leave the interpretation to the executive branch: Whether those credits are available on Federal Exchanges is . . . a question of deep "economic and political significance" that is central to this statutory scheme; had Congress wished to assign that question to an agency, it surely would have done so expressly. It is especially unlikely that Congress would have delegated this decision to the IRS, which has no expertise in crafting health insurance policy of this sort. This is not a case for the IRS. It is instead our task to determine the correct reading of Section 36B. The "correct interpretation," in the majority's view, is the administration's, because it makes more sense in the "context" of "the overall statutory scheme." Try wrapping your mind around that: The court asserts that the language of the statute is ambiguous at the same time it holds that the meaning of that language is not. The court's declaring an authoritative interpretation rather than applying Chevron deference has an important practical effect: It binds future administrations to interpret the law the same way this one does. And as Scalia points out, this is not the first time the justices have "revised major components of the statute in order to save them." He rehearses the holding of NFIB: The Act that Congress passed provides that every individual "shall" maintain insurance or else pay a "penalty." This Court, however, saw that the Commerce Clause does not authorize a federal mandate to buy health insurance. So it rewrote the mandate-cum-penalty as a tax. The Act that Congress passed also requires every State to accept an expansion of its Medicaid program, or else risk losing all Medicaid funding. This Court, however, saw that the Spending Clause does not authorize this coercive condition. So it rewrote the law to withhold only the incremental funds associated with the Medicaid expansion. Having transformed two major parts of the law, the Court today has turned its attention to a third. The Act that Congress passed makes tax credits available only on an "Exchange established by the State." This Court, however, concludes that this limitation would prevent the rest of the Act from working as well as hoped. So it rewrites the law to make tax credits available everywhere. We should start calling this law SCOTUScare. The majority acknowledges that the ObamaCare is a bit of a mess, or, as Roberts understatedly puts it, that it "contains more than a few examples of inartful drafting": Several features of the Act's passage contributed to that unfortunate reality. Congress wrote key parts of the Act behind closed doors, rather than through "the traditional legislative process." And Congress passed much of the Act using a complicated budgetary procedure known as "reconciliation," which limited opportunities for debate and amendment, and bypassed the Senate's normal 60-vote filibuster requirement. As a result, the Act does not reflect the type of care and deliberation that one might expect of such significant legislation. Scalia's answer: It is not our place to judge the quality of the care and deliberation that went into this or any other law. . . . Much less is it our place to make everything come out right when Congress does not do its job properly. It is up to Congress to design its laws with care, and it is up to the people to hold them to account if they fail to carry out that responsibility. One of Scalia's colleagues agrees: Members of this Court are vested with the authority to interpret the law; we possess neither the expertise nor the prerogative to make policy judgments. Those decisions are entrusted to our Nation's elected leaders, who can be thrown out of office if the people disagree with them. It is not our job to protect the people from the consequences of their political choices. That was the extended version of the Roberts quote from NFIB with which we opened today's column. How can these two jurists, who broadly agree in principle about the court's proper role, apply those principles in such radically different ways? Here's one hypothesis: A few months after the court handed down NFIB, Barack Obama was re-elected (albeit with the help of IRS's abuse of his political opponents, a qualification that is especially poignant today). Perhaps that is the only "political choice" the chief justice has in mind. As Finley Peter Dunne's Mr. Dooley observed, "th' Supreme Coort follows th' election returns." No. 1: SCOTUS Is a 'Threat' "I write separately to call attention to this Court's threat to American democracy." No. 2: Our New Rulers " t is not of special importance to me what the law says about marriage. It is of overwhelming importance, however, who it is that rules me. Today's decree says that my Ruler, and the Ruler of 320 million Americans coast-to-coast, is a majority of the nine lawyers on the Supreme Court. The opinion in these cases is the furthest extension in fact-and the furthest extension one can even imagine-of the Court's claimed power to create 'liberties' that the Constitution and its Amendments neglect to mention. This practice of constitutional revision by an unelected committee of nine, always accompanied (as it is today) by extravagant praise of liberty, robs the People of the most important liberty they asserted in the Declaration of Independence and won in the Revolution of 1776: the freedom to govern themselves." No. 3: Naked Claim to Power "This is a naked judicial claim to legislative-indeed, super-legislative-power; a claim fundamentally at odds with our system of government. Except as limited by a constitutional prohibition agreed to by the People, the States are free to adopt whatever laws they like, even those that offend the esteemed Justices' 'reasoned judgment.' A system of government that makes the People subordinate to a committee of nine unelected lawyers does not deserve to be called a democracy." No. 4: 'Pretentious' and 'Egotistic' "The opinion is couched in a style that is as pretentious as its content is egotistic. It is one thing for separate concurring or dissenting opinions to contain extravagances, even silly extravagances, of thought and expression; it is something else for the official opinion of the Court to do so." No. 5: Five Justices Think They Know All "The five Justices who compose today's majority are entirely comfortable concluding that every State violated the Constitution for all of the 135 years between the Fourteenth Amendment's ratification and Massachusetts' permitting of same-sex marriages in 2003. They have discovered in the Fourteenth Amendment a 'fundamental right' overlooked by every person alive at the time of ratification, and almost everyone else in the time since. They see what lesser legal minds-minds like Thomas Cooley, John Marshall Harlan, Oliver Wendell Holmes, Jr., Learned Hand, Louis Brandeis, William Howard Taft, Benjamin Cardozo, Hugo Black, Felix Frankfurter, Robert Jackson, and Henry Friendly-could not. They are certain that the People ratified the Fourteenth Amendment to bestow on them the power to remove questions from the democratic process when that is called for by their 'reasoned judgment.' These Justices know that limiting marriage to one man and one woman is contrary to reason; they know that an institution as old as government itself, and accepted by every nation in history until 15 years ago, cannot possibly be supported by anything other than ignorance or bigotry. And they are willing to say that any citizen who does not agree with that, who adheres to what was, until 15 years ago, the unanimous judgment of all generations and all societies, stands against the Constitution." No. 6: Court's Reputation Diminished "The stuff contained in today's opinion has to diminish this Court's reputation for clear thinking and sober analysis." No. 7: 'Profoundly Incoherent' " he opinion's showy profundities are often profoundly incoherent. 'The nature of marriage is that, through its enduring bond, two persons together can find other freedoms, such as expression, intimacy, and spirituality.' (Really? Who ever thought that intimacy and spirituality were freedoms? And if intimacy is, one would think Freedom of Intimacy is abridged rather than expanded by marriage. Ask the nearest hippie. Expression, sure enough, is a freedom, but anyone in a long-lasting marriage will attest that that happy state constricts, rather than expands, what one can prudently say.) "Rights, we are told, can 'rise . . . from a better informed understanding of how constitutional imperatives define a liberty that remains urgent in our own era.' (Huh? How can a better informed understanding of how constitutional imperatives define an urgent liberty , give birth to a right?) "And we are told that, ' n any particular case,' either the Equal Protection or Due Process Clause 'may be thought to capture the essence of right in a more accurate and comprehensive way,' than the other, 'even as the two Clauses may converge in the identification and definition of the right.' (What say? What possible 'essence' does substantive due process 'capture' in an 'accurate and comprehensive way'? It stands for nothing whatever, except those freedoms and entitlements that this Court really likes. And the Equal Protection Clause, as employed today, identifies nothing except a difference in treatment that this Court really dislikes. Hardly a distillation of essence. If the opinion is correct that the two clauses 'converge in the identification and definition of right,' that is only because the majority's likes and dislikes are predictably compatible.)" No. 8: Supreme Court 'Ends' Public Debate "When the Fourteenth Amendment was ratified in 1868, every State limited marriage to one man and one woman, and no one doubted the constitutionality of doing so. ... Since there is no doubt whatever that the People never decided to prohibit the limitation of marriage to opposite-sex couples, the public debate over same-sex marriage must be allowed to continue. "But the Court ends this debate, in an opinion lacking even a thin veneer of law." No. 9: A 'Judge-Empowering' Decision "Buried beneath the mummeries and straining-to-be-memorable passages of the opinion is a candid and startling assertion: No matter what it was the People ratified, the Fourteenth Amendment protects those rights that the Judiciary, in its 'reasoned judgment,' thinks the Fourteenth Amendment ought to protect. That is so because ' he generations that wrote and ratified the Bill of Rights and the Fourteenth Amendment did not presume to know the extent of freedom in all of its dimensions . . . . ' One would think that sentence would continue: '. . . and therefore they provided for a means by which the People could amend the Constitution,' or perhaps '. . . and therefore they left the creation of additional liberties, such as the freedom to marry someone of the same sex, to the People, through the never-ending process of legislation.' But no. What logically follows, in the majority's judge-empowering estimation, is: 'and so they entrusted to future generations a charter protecting the right of all persons to enjoy liberty as we learn its meaning.' The 'we,' needless to say, is the nine of us." No. 10: Violating Principles " o allow the policy question of same-sex marriage to be considered and resolved by a select, patrician, highly unrepresentative panel of nine is to violate a principle even more fundamental than no taxation without representation: no social transformation without representation." No. 11: Overthrowing the Government " hat really astounds is the hubris reflected in today's judicial Putsch." No. 12: 'One Step Closer ...' "With each decision of ours that takes from the People a question properly left to them-with each decision that is unabashedly based not on law, but on the 'reasoned judgment' of a bare majority of this Court-we move one step closer to being reminded of our impotence." http://ift.tt/1LOxg3C

06/27/2015 on a breaking news segment of CNN Newsroom with Fredricka Whitfield, substitute anchor Susan Malvo cut to reporter Lucy Pawle whom reportedly spotted an ISIS flag amongst the LGBT flags during the London gay pride celebrations. She was quick to photograph the flag and went on to report that this was "clearly an ISIS flag" with "distinct Arabic lettering". They even interviewed via telephone CNN terrorism expert Peter Bergman, whom expressed alarm at the sighting. However,on closer inspection the Arabic letters turned out to be nothing more than pictures of dildos and butt plugs! Morons!

Saturday, June 27, 2015

Turkey went to general elections on June the 7th of 2015 . The ruling AKP (Justice and Development Party, leadered by Erdogan and headed by Ahmet Davutoglu) received 40.86 percent of the votes, losing 9% of the votes and the absolute majority in the parliament. The CHP (Republican People's Party) has gained 24.94% of the votes, losing one percent in comparison to the last elections of 2011. Third became MHP (Party of Nationalist Movement) with 16.28%, a plus of approximately 3%. The HDP (Party of the Democracy of the Peoples) has received 13.11%. Due to legislation that prescribes for political parties at least a voters support of 10% to be presented in the parliament, the HDP formerly had participated with individual and independent candidates. Therefore a direct comparison seems difficult, but it is estimated that the party has gained around 7% of the votes. The Patriotic Party (Turkey) received 0.35% of the votes, becoming the 6th biggest party in the election results. The Deputy Chairman of the Patriotic Party, Yunus Soner evaluated the election results. Soner made the following declaration : Turkey is heading towards what we call the 'radical solution'. Our country is facing two different and main challenges. Economic Crisis . During the last 50 years, the Turkish economy has been integrated and consumed by the world economy. During the last 12 years of AKP government, the economy has turned to a 'dictatorship of hot money'. It's functioning became dependent on the pursuit of credit, but this course of politics has come to an end. This year's debt alone forces the government to find approximately 250 billion US Dollars of new debt -- an enterprise condemned to fail. Therefore, the Turkish economy and the society will face a huge crisis that will question Turkey's integration into global capital markets and the system of financial speculation. Turkey's alternative to this failure is to turn to an economy of production with a mixed model under public leadership. Ethnic Division . Together with Iran, Iraq and Syria, Turkey faces the threat of ethnic and sectarian division. Foreign Minister of that time, later President of the State and now an internationally discussed candidate for the position of Prime minister, Abdullah Gul had declared to the Turkish press already in 2004 that he had signed an agreement of 'two pages and 9 articles' with US Foreign Minister Colin Powell. That agreement together with the following politics pursued the US politics towards Turkey aiming at: . The legalization of the armed group PKK . A new constitution, deleting 'the Turkish nation' and introducing various ethnical and sectarian groups as political entities and introducing regional autonomy The US Position: AKP-CHP Coalition . In short, maintaining Turkey within the economy of speculation despite debt crisis and dividing the country was the US program for the elections. The US has analyzed that the ongoing AKP government was not able to fulfill these two program points. The AKP was not able to govern Turkey alone any more. Washington thus pursued actively a coalition between AKP and CHP. As an external leg of this coalition and a step towards the legalization of the PKK, the HDP, its legal arm was to pass the 10% parliamentary threshold. This coalition also was meant to limit aspirations of Erdogan, a long time US-ally and formerly hailed for in the Western press. In the past years though, Erdogan was criticized for slowing down the so called peace process, the negotiations with the PKK. He was also harshly criticized in Western media for his government's recent politics against the group of Fethullah Gulen, leader of a religious sect and economic interest group, living in exile in the US. Gulen and his organizations have long been known and documented in the Turkish press and the state documents as an undercover organization connected to the so called Gladio. US Election Campaign . In accordance with the analysis and the aim of coalition funding, pro-American Turkish media and international organizations started a campaign against Erdogan on the one hand and pro-HDP on the other. Concerning the economic crisis, the appointment of Kemal Dervis, former World Bank expert and IMF manager of the last crisis in 2001, as designated minister of economy for the CHP showed the way. Concerning the new constitution, the coalition parties and the HDP declared very fast their will to work together. As a core element, the HDP was presented in the elections as a political party independent from the PKK, with CHP leaders openly calling to vote for the HDP. The election campaign ended in the last days with editorials in media like the New York Times and the Economist calling openly to vote against Erdogan and for the HDP. A bomb that was placed on a demonstration of the HDP on the very last day of the campaign added to the constructed contradiction between the HDP and Erdogan. The Results . As the results given above show, the US project has come true. The election results reflect ethnic and sectarian division. A coalition that promises to govern economic crisis and deepen Turkey's division is on the horizon. With the HDP, a political party that receives orders from an armed terrorist organization has arrived in the middle of the parliament. Noteworthy is that the US calls this organization 'our current best allies in the Middle East'. As has been demanded by the US, the expected AKP-CHP coalition will limit the authority of President Erdogan. His reluctance in implementing the politics of division, his steps towards Eurasia and his policy towards Syria will be cancelled in favor of a more pro-American approach. The Patriotic Party . The Patriotic Party has fought an election campaign based on the slogan 'reuniting Turkey, producing Turkey'. Highlights of the election campaign were an official visit of solidarity and friendship to Syria's President al Assad and a demonstration of unity in predominantly Kurdish populated province of Hakkari. Another important step was the decision of the European Court of Human Rights in favor of Patriotic Party's Chairman Perincek, ruling that the events of 1915 do not constitute 'genocide' in legal terms and differ substantially from the Holocaust. In spite of the election campaign, the Patriotic Party has received a result that is considered absolutely unsatisfying. The US based opinion making process and the 10% threshold appear as important external factors. The Patriotic Party's organs will also come together and analyze deeply different internal factors and develop lessons for the coming political struggle. Still, the analysis of the challenges has not changed. After the election, Turkey keeps on facing an economic crisis and the threat of balkanization. The Patriotic Party (Turkey) is willing to face these challenges as decided as before. _ http://ift.tt/1KkEjUd _

A progressive panic attack begins as the Obama era wanes. If it seems to you that the Left has, collectively, lost its damned mind as the curtain rises on the last act of the Obama administration, you are not imagining things. Barack Obama has been extraordinarily successful in his desire to - what was that phrase? - fundamentally transform the country, but the metamorphosis is nonetheless a good deal less than his congregation wanted and expected. We may have gone from being up to our knees in welfare-statism to being up to our hips in it, and from having a bushel of banana-republic corruption and incompetence to having a bushel and a peck of it, but the United States of America remains, to the Left's dismay, plainly recognizable as herself beneath the muck. Ergo, madness and rage. We have seen an extraordinary outburst of genuine extremism - and genuine authoritarianism - in the past several months, and it will no doubt grow more intense as we approach the constitutional dethroning of the mock messiah to whom our progressive friends literally sang hymns of praise and swore oaths of allegiance. ("I pledge to be a servant to our president" - recall all that sieg heil creepiness.) There is an unmistakable stink of desperation about this, as though the Left intuits what the Right dares not hope: that the coming few months may in fact see progressivism's cultural high-water mark for this generation. If there is desperation, it probably is because the Left is starting to suspect that the permanent Democratic majority it keeps promising itself may yet fail to materialize. The Democrats won two resounding White House victories but can hardly win a majority in a state legislature (seven out of ten today are Republican-controlled) or a governorship (the Democrats are down to 18) to save their lives, while Republicans are holding their strongest position in Congress since the days of Herbert Hoover. The Democrats have calculated that their best bet in 2016 is Hillary Rodham Clinton, that tragic bag of appetites who couldn't close the deal in the primary last time around. "Vote for me, I'm a lady" isn't what they thought it was: Wendy Davis, running for governor of Texas, made all the proper ceremonial incantations and appeared in heroic postures on all the right magazine covers, but finished in the 30's on Election Day. With young people trending pro-life, that old black magic ain't what it used to be. For the Left, it feels like time is running out. So it isn't sufficient that same-sex marriages be legalized; bakers and florists must be locked in prison if they decline to participate in a gay couple's ceremony. It isn't sufficient that those wishing to undergo sex-change surgery be permitted to go their own way; the public must pay for it, and if Bruce Jenner is still "Bruce" to you, you must be driven from polite society. It isn't enough that the Left dominate the media and pop culture; any attempt to compete with it must be criminalized in the name of "getting big money out of politics." Not the New York Times's money, or Hollywood's money, or the CEO of Goldman Sachs's money - just the wrong sort of people's money. Every major Democratic presidential candidate and every Democratic senator is on record supporting the repeal of the First Amendment's free-speech protections - i.e., carving the heart out of the Bill of Rights - to clear the way for putting all public debate under political discipline. Like it or not, you will be shackled to hope and change. The hysterical shrieking about the fictitious rape epidemic on college campuses, the attempts to fan the unhappy events in Ferguson and Baltimore into a national racial conflagration, the silly and shallow "inequality" talk - these are signs of progressivism in decadence. So is the brouhaha over the Confederate flag in South Carolina in the wake of the horrific massacre at Emanuel AME Church. For about 30 seconds, the political ghouls of the Left were looking to pick another gun-control fight, swooping in, in their habitually indecent fashion, before the bodies had even grown cold. But that turned out to be a dead end, since the killer acquired his gun after passing precisely the sort of background check that the Left generally hawks after a high-profile crime, regardless of whether it is relevant to the crime. We might have spent some time thinking about whether law enforcement was too lax in the matter of the murderer's earlier encounters with them - the South Carolina killer had a drug arrest on his record but was able to buy a gun because he had been charged only with a misdemeanor. But the Left isn't in any mood to talk about whether the cops aren't being hard-assed enough. So, instead, we had a fight over a completely unrelated issue: the Confederate flag flying at the state capitol in Columbia. You have to credit the Left: Its strategy is deft. If you can make enough noise that sounds approximately like a moral crisis, then you can in effect create a moral crisis. Never mind that the underlying argument - "Something bad has happened to somebody else, and so you must give us something we want!" - is entirely specious; it is effective. In the wake of the financial crisis, we got all manner of "reform," from student-lending practices to the mandates of Elizabeth Warren's new pet bureaucracy, involving things that had nothing at all to do with the financial crisis. Democrats argued that decency compelled us to pass a tax increase in the wake of the crisis, though tax rates had nothing to do with it. A crisis is a crisis is a crisis, and if a meteor hits Ypsilanti tomorrow you can be sure that Debbie Stabenow will be calling for a $15 national minimum wage because of the plight of meteor victims. If you can make enough noise that sounds approximately like a moral crisis, then you can in effect create a moral crisis. I bear no brief for the peckerwood-trash cultural tendencies that led Fritz Hollings, then governor, and the rest of the loyal Democrats who ran segregation-era South Carolina to hoist the Confederate flag in 1962. My sympathies are more with John Brown than with John Calhoun. Yet Lost Cause romanticism was very much in fashion for a moment, and not only among Confederate revanchists; Joan Baez, no redneck she, made a great deal of money with her recording of "The Night They Drove Old Dixie Down" in 1971. About every third Western of the era had as its hero a conflicted Confederate veteran, his wounded honor and stoicism in defeat compelling him to roam westward in search of a new beginning. That story lives on into our own time: Who are Mal Reynolds and the Browncoats if not another remnant of the Lost Cause relocated from Virginia to the frontier in space? On the 99th anniversary of the verdict, we examine the murder of Mary Phagan and the trial of Leo Frank (Illustration: autopsy photo). by Mark Cohen THE CENTURY-OLD "cold case" Mary Phagan murder mystery - the violent rape and murder of teenager Mary Phagan and the subsequent lynching of the convicted killer, Jewish businessman Leo Frank - has now been conclusively solved by scholars using the extensive 1913 official investigation and trial records. In this once-in-a-lifetime event, the publishing, mass media, and academic establishments - who have for decades promoted the conspiracy theory that anti-Semites framed Frank for the crime because he was Jewish - have been proven to be wrong by the statements of Leo Frank himself . Leo Frank In addition to being an executive of Atlanta's National Pencil Company, Leo Frank was also a B'nai B'rith official - president of the 500-member Gate City Lodge in 1912 - and even after his conviction and incarceration Frank was elected lodge president again in 1913. As a direct result of the Leo Frank conviction, the B'nai B'rith founded their well-known and politically powerful "Anti-Defamation League," or ADL. At the climax of the Leo Frank trial, an admission was made by the defendant that amounted to a confession during trial. How many times in the annals of US legal history has this happened? Something very unusual happened during the month-long People v. Leo M. Frank murder trial, held within Georgia's Fulton County Superior Courthouse in the Summer of 1913. I'm going to show you evidence that Mr. Leo Max Frank inadvertently revealed the solution to the Mary Phagan murder mystery. When Leo Frank mounted the witness stand on Monday afternoon, August 18, 1913, at 2:15 pm, he orally delivered an unsworn, four-hour, pre-written statement to the 250 people present. The Leo Frank trial Epic Trial of 20th Century Southern History The audience sat in the grandstand seats of the most spectacular murder trial in the annals of Georgia history. Nestled deep within the pews of the Fulton County Superior Court were the luckiest of public spectators, defense and prosecution witnesses, journalists, officials, and courtroom staff. Hugh M. Dorsey Like gladiators in an arena, in the center of it all, with their backs to the audience, seated in ladder-back chairs, were the most important principals. They were the State of Georgia's prosecution team, made up of three members, led by Solicitor General Hugh M. Dorsey and Frank Arthur Hooper. Arrayed against them were eight Leo Frank defense counselors, led by Luther Z. Rosser and Reuben Rose Arnold. The presiding judge, the Honorable Leonard Strickland Roan, sitting in a high-backed leather chair, was separated by the witness stand from the jury of 12 white men who were sworn to justly decide the fate of Leo Frank. Crouched and sandwiched between the judge's bench and the witness chair, sitting on the lip of the bench's foot rail, was a stenographer capturing the examinations. Stenographers clicked away throughout the trial and were changed regularly in relays. Reuben R. Arnold Surrounding the four major defense and prosecution counselors were an entourage of uniformed police, plainclothes detectives, undercover armed security men, government staff, and magistrates. The first day of the Leo Frank trial began on Monday morning, July 28, 1913, and led to many days of successively more horrifying revelations. But the most interesting day of the trial occurred three weeks later when Leo Frank sat down in the witness stand on Monday afternoon, August 18, 1913. The Moment Everyone Was Waiting For What Leo Frank had to say to the court became the spine-tingling climax of the most notorious criminal trial in US history, and it was the moment everyone in all of Georgia, especially Atlanta, had waited for. Leo Frank posing for Collier's Weekly. The photo would later become the front cover for the book The Truth About the Frank Case by C.P. Connolly. In the picture, the fingertips of Leo Frank's left hand are firmly clasped around the base of a cigar, vertically projecting upward from his groin region. The significance of Leo Frank's left fist would be revealed when the Mary Phagan autopsy, conducted on Monday, May 5, 1913, by Dr. H. F. Harris, was reported during the Leo Frank trial. Judge Roan explained to the jury the unique circumstances and rules concerning the unsworn statement Leo M. Frank was to make. Then, at 2:14 pm, Leo Frank was called to speak. When he mounted the stand, a hush fell as 250 spellbound people closed ranks and leaned forward expectantly. They were more than just speechless: They were literally breathless, transfixed, sitting on the edges of their seats, waiting with great anticipation for every sentence, every word, that came forth from the mouth of Leo Frank. But listening to his long speech became challenging at times. He had a reputation as a "gas jet" from his college days (see his college yearbook entry), and he lived up to it now with dense, mind-numbing verbiage. Three Out of Nearly Four Hours: Distractions and Endless Pencil Calculations To bring his major points home during his almost four-hour speech, Leo Frank presented original pages of his accounting books to the jury. For three hours he went over, in detail, the accounting computations he had made on the afternoon of April 26, 1913. This was meant to show the court that he had been far too busy to have murdered Mary Phagan on that day nearly 15 weeks before. Leo Frank's reputation as a "hot air artist" - and service as a debating coach - shown in his college yearbook entry One point emphasized by the defense was how long it took Frank to do the accounting books: Was it an hour and a half as some said, or three hours? Can either answer ever be definitive, though? No matter how quickly one accountant works, is it beyond belief that another could be twice as fast? The Ultimate Question Waiting to be Answered Monteen Stover The most important unanswered question in the minds of everyone at the trial was this: Where had Leo Frank gone between 12:05 pm and 12:10 pm on Saturday, April 26, 1913? This was the crucial question because Monteen Stover had testified she found Leo Frank's office empty during this five-minute time segment - and Leo Frank had told police he never left his office during that time. And the evidence had already shown that Mary Phagan was murdered sometime between 12:05 and 12:15 pm in the Metal Room of the same factory where Leo Frank was present. There weren't a plethora of suspects in the building: April 26, 1913, was a state holiday in Georgia - Confederate Memorial Day - and the factory and offices were closed down, except for a few employees coming in to collect their pay and two men doing construction work on an upper floor. Two investigators had testified that Leo Frank gave them the alibi that he had never left his office from noon until after 12:45. If Leo Frank's alibi held up, then he couldn't have killed Mary Phagan. Everyone wanted to know how Leo Frank would respond to the contradictory testimony clashing with his alibi. And, after rambling about near-irrelevancies for hours, he did: Frank stated - in complete contradiction to his numerous earlier statements that he'd never left his office - that he might have "unconsciously" gone to the bathroom during that time - placing him in the only bathroom on that floor of the building, the Metal Room bathroom, which is where Jim Conley stated he had first found the lifeless body of little Mary Phagan, and immediately adjacent to the Metal Room proper, where Mary Phagan's blood was found, and where the prosecution had spent weeks proving that the murder had actually taken place. Paul Donehoo This was doubly amazing because weeks earlier Leo Frank had emphatically told the seven-man panel led by Coroner Paul Donehoo at the Coroners Inquest, that he (Leo Frank) did not use the bathroom all day long - not that he (Leo Frank) had forgotten, but that he had not gone to the bathroom at all . The visually-blind but prodigious savant Coroner Paul Donehoo - with his highly-refined "B.S. detector" was incredulous as might be expected. Who doesn't use the bathroom all day long? It was as if Leo Frank was mentally and physically, albeit crudely and unbelievably, trying to distance himself from the bathroom where Jim Conley said he found the body. Furthermore, Leo Frank had told detective Harry Scott - witnessed by a police officer named Black - that he (Leo Frank) was in his office every minute from noon to half past noon , and in State's Exhibit B (Frank's stenographed statement to the police), Leo Frank never mentions a bathroom visit all day. And now he had reversed himself! Why would Leo Max Frank make such a startling admission, after spending months trying to distance himself from that part of the building at that precise time? That is a difficult question to answer, but there are clues. 1) The testimony of Monteen Stover (who liked Frank and who was actually a supportive character witness for him) that Frank was missing from his office for those crucial five minutes was convincing. Few could believe that Stover - looking to pick up her paycheck, and waiting five minutes in the office for an opportunity to do so - would have been satisfied with a cursory glance at the room and therefore somehow missed Frank behind the open safe door as he had alleged. 2) The evidence suggests that Frank did not always make rational decisions when under stress: Under questioning from investigators, he repeatedly changed the time at which Mary Phagan supposedly came to see him in his office (and State's Exhibit B shows that Frank, in the presence of his lawyers, told police that Mary Phagan was in his office with him alone between 12:05 and 12:10 pm); he reportedly confessed his guilt to his wife the day of the murder; he, if guilty, reacted out of all proportion and reason to being spurned by his teenage employee; and he maintained the utterly unbelievable position throughout the case that he did not know Mary Phagan by name, despite indisputably knowing her initials (he wrote them on the company books by hand) and interacting with her hundreds of times. Mary Phagan Frank had also said (to paraphrase his statement before the racial angle had been brought forward by his defense team) that to the best of his recollection when he was in his second floor office from 12:00 to 12:45 pm, aside from temporary visitors, the only other people continuously in the building he was aware of were Mr. White and Mr. Denham on the fourth floor, banging away and doing construction as they tore down a partition. That's it, three people. One can understand investigators, after hearing Frank's statement that there were only three people in the building, asking the question: If there are three people in the factory, and two of them didn't do it, who is left? Even if only one of these lapses is true as described, it is enough to show a pronounced lack of judgement on Frank's part. A man with such impaired judgement may actually have been unable to see that by explaining away his previous untenable (and now exposed as false) position of "never leaving the office" with an "unconscious" bathroom visit, he was placing himself at the scene of the murder at the precise time of the murder. Thus are men who tell tales undone, even as they fall back upon a partial truth. Georgia: Right to Refuse Oaths and Examination Under the Georgia Code, Section 1036, the accused has the right to make an unsworn statement and, furthermore, to refuse to be examined or cross-examined at his trial. Leo Frank made the decision to make an unsworn statement and not allow examination or cross examination. The law also did not permit Solicitor General Hugh M. Dorsey or his legal team to orally interpret or comment on the fact that Leo Frank was not making a statement sworn under oath at his own murder trial. The prosecution respected this rule. The jury knew that Leo Frank had had months to carefully prepare his statement. But what was perhaps most damaging to Leo Frank's credibility was the fact that every witness at the trial, regardless of whether they were testifying for the defense or prosecution, had been sworn, and therefore spoke under oath, and had been subject to cross-examination by the other side - except for Leo Frank . Thus it didn't matter if the law prevented the prosecution from commenting on the fact Leo Frank had refused cross examination, opting instead to make an unsworn statement, because the jury could see that anyway. Making an unsworn statement and refusing to be examined does not prove that one is guilty, but it certainly raises eyebrows of doubt. Leo Frank takes the stand The South an "Honor Bound" Society Could a sworn jury upholding its sacred duty question Leo Frank's honor and integrity as a result of what Southerners likely perceived as his cowardly decision under Georgia Code, Section 1036? If so, greater weight would naturally be given to those witnesses who were sworn under oath and who contradicted Leo Frank's unsworn alibis, allegations, and claims. It put the case under a new lens of the sworn versus the unsworn. The average Southerner in 1913 was naturally asking the question: What white man would make an unsworn statement and not allow himself to be cross-examined at his own murder trial if he were truly innocent? Especially in light of the fact that the South was culturally white separatist - and two of the major material witnesses who spoke against Leo Frank were African-Americans, one claiming to be an accomplice after the fact turned accuser. In the Atlanta of 1913, African-Americans were perceived as second class citizens and less reliable than whites in terms of their capacity for telling the truth. Today , we might ask: Why wouldn't Leo Frank allow himself to be cross examined when he was trained in the art and science of debating during his high school senior year and all through his years in college, where he earned the rank of Cornell Congress Debate Team coach? ( Pratt Institute Monthly , June, 1902; Cornellian , 1902 through 1906; Cornell Senior Class Book , 1906; Cornell University Alumni Dossier File on Leo Frank, retrieved 2012) Odd Discrepancies Newt Lee Most Leo Frank partisan authors omit significant parts of the trial testimony of Newt Lee and Jim Conley from their retelling of the Leo Frank Case. Both of these black men, former National Pencil Company employees, made clearly damaging statements against Frank. The evidence Newt Lee brought forward was circumstantial, but intriguing - and never quite adequately explained by Leo Frank then, or by his defenders now. He stated that on Friday Evening, April 25, 1913, Frank made a request to him, Lee, that he report to work an hour early at 4:00 pm on Confederate Memorial Day, the next day. The stated reason was that Leo Frank had made a baseball game appointment with his brother-in-law, Mr. Ursenbach, a Gentile who was married to one of Frank's wife Lucille's older sisters. Leo Frank would eventually give two different reasons at different times as to why he canceled that appointment: 1) he had too much work to do, and 2) he was afraid of catching a cold. Newt Lee's normal expected time at the National Pencil Company factory on Saturdays was 5:00 pm sharp. Lee stated that when he arrived an hour early that fateful Saturday, Leo Frank had forgotten the change because he was in an excited state. Frank, he said, was unlike his normal calm, cool and collected "boss-man" self. Normally, if anything was out of order, Frank would command him, saying "Newt, step in here a minute" or the like. Instead, Frank burst out of his office, bustling frenetically towards Lee, who had arrived at the second floor lobby at 3:56 pm. Upon greeting each other, Frank requested that Lee go out on the town and "have a good time" for two hours and come back at 6:00 pm. Because Leo Frank asked Newt Lee to come to work one hour early, Lee had lost that last nourishing hour of sleep one needs before waking up fully rejuvenated, so Lee requested of Frank that he allow him to take a nap in the Packing Room (adjacent to Leo Frank's front office). But Frank re-asserted that Lee needed to go out and have a good time. Finally, Newt Lee acquiesced and left for two hours. At trial, Frank would state that he sent Newt Lee out for two hours because he had work to do. When Lee came back, the double doors halfway up the staircase were locked - very unusual, as they had never had been locked before on Saturday afternoons. When Newt Lee unlocked the doors and went into Leo Frank's office he witnessed his boss bungling and nearly fumbling the time sheet when trying to put a new one in the punch clock for the night watchman - Lee - to register. The National Pencil Company building around 1913 It came out before the trial that Newt Lee had earlier been told by Leo Frank that it was a National Pencil Company policy that once the night watchman arrived at the factory - as Lee had the day of the murder at 4:00 pm - he was not permitted to leave the building under any circumstances until he handed over the reigns of security to the day watchman. Company security necessitated being cautious - poverty, and therefore theft, was rife in the South; there were fire risk hazards; and the critical factory machinery was worth a small fortune. Security was a matter of survival. The two hour timetable rescheduling - the canceled ball game - the inexplicable sudden security rule waiver - the bumbling with a new time sheet - the locked double doors - and Frank's suspiciously excited behavior: All were highlighted as suspicious by the prosecution, especially in light of the fact that the "murder notes" - found next to Mary Phagan's head - physically described Newt Lee, even calling him "the night witch." And, the prosecutor asked, why did Leo Frank later telephone Newt Lee, not once but two or more times, that evening at the factory? A "Racist" Subplot? The substance of what happened between Newt Lee (and janitor James "Jim" Conley - see below) and Leo Frank from April 26, 1913 onward is most often downplayed, censored, or distorted by partisans of Leo Frank. From the testimony of these two African-American witnesses, we learn of an almost diabolic intrigue calculated to entrap the innocent night watchman Newt Lee. It would have been easy to convict a black man in the white separatist South of that time, where the ultimate crime was a black man having interracial sex with a white woman - to say nothing of committing battery, rape, strangulation, and mutilation upon her in a scenario right out of Psychopathia Sexualis . Luther Z. Rosser, for the defense The plot was exquisitely formulated for its intended audience, the twelve white men who would decide Leo Frank's fate. It created two layers of African-Americans between Frank and the murder of Mary Phagan. It wouldn't take the police long to realize Newt Lee didn't commit the murder, and, since the death notes were written in dialect, it would leave the police hunting for another black murderer. As long as Jim Conley kept his mouth shut, he wouldn't hang. So the whole plot rested on Jim Conley - and it took the police three weeks to crack him. The ugly racial element of this defense ploy is rarely mentioned today. The fact that it was Leo Frank, a Jew (and generally considered white in the racial separatist Old South), who first tried to pin the rape and murder of Mary Phagan on the elderly, balding, and married African-American Newt Lee (who had no criminal record to boot) is not something that Frank partisans want to highlight. The Leo Frank cheering section also downplays the racial considerations that made Frank, when his first racially-tinged defense move failed and was abandoned, change course for the last time and formulate a new subplot to pin the crime on Jim Conley, the "accomplice after the fact." If events had played out as intended, there would have likely been one or two dead black men in the wake of the defense team's intrigue. Jim Conley knew too much. He admitted he had helped the real murderer, Leo Frank, clean up after the fact. To prevent Conley, through extreme fear, from revealing any more about the real solution to the crime, and to discredit him no matter what he did, a new theory was needed. Jim Conley certainly was scared beyond comprehension, knowing what white society did to black men who beat, raped, and strangled white girls. The Accuser Becomes the Accused Jim Conley The new murder theory posited by the Leo Frank defense was that Jim Conley assaulted Mary Phagan as she walked down the stairs from Leo Frank's office. Once Phagan descended to the first floor lobby, they said, she was robbed, then thrown down 14 feet to the basement through the two-foot by two-foot scuttle hole at the side of the elevator. Conley then supposedly went through the scuttle hole himself, climbing down the ladder, dragged the unconscious Mary Phagan to the garbage dumping ground in front of the cellar incinerator (known as the "furnace"), where he then raped and strangled her. But this grotesque racially-tinged framing was to fail in the end - in part because because physicians noticed that the scratch marks on Mary Phagan's face - she had been dragged face down in the basement - did not bleed , strongly suggesting she was already quite dead when the dragging took place. Investigators arranged for a conversation to take place between Leo Frank and Newt Lee, who were intentionally put alone together in a police interrogation room at the Atlanta Police Station. The experiment was to see how Frank would interact with Lee and determine if any new information could be obtained. Once they thought they were alone, Leo Frank scolded Newt Lee for trying to talk about the murder of Mary Phagan, and said that if Lee kept up that kind of talk, Frank and he would go straight to hell. Leo Frank in the courtroom; his wife Lucille Frank behind him Star Witnesses The Jewish community has crystallized around the notion that Jim Conley was the star witness at the trial, and not 14-year-old Monteen Stover who defended Leo Frank's character - and then inadvertently broke his alibi. Leo Frank partisans downplay the significance of Monteen Stover's trial testimony and Leo Frank's attempted rebuttal of her testimony on August 18, 1913. Governor John M. Slaton also ignored the Stover-Frank incident in his 29-page commutation order of June 21, 1915. Many Frank partisans have chosen to obscure the significance of Monteen Stover by putting all the focus on Jim Conley, and then claiming that without Jim Conley there would have been no conviction of Leo Frank. Could they be right? Or could Leo Frank have been convicted on the testimony of Monteen Stover, without the testimony of Jim Conley? It is a question left for speculation only, because no one ever anticipated the significance of Jim Conley telling the jury that he had found Mary Phagan dead in the Metal Room bathroom. It was not until Leo Frank gave his response to Monteen Stover's testimony - his explanation of why his second floor business office was empty on April 26, 1913 between 12:05 pm and 12:10 pm - that everything came together tight and narrow . Tom Watson resolved the "no conviction without Conley" controversy in the September 1915 number of his Watson's Magazine , but perhaps it is time for a 21st century explanation to make it clear why even the Georgia Supreme Court ruled that the evidence and testimony of the trial sustained Frank's conviction. August 18, 1913: You Are the Jury The four-hour-long unsworn statement of Leo Frank was the crescendo of the trial. (Later, just before closing arguments, Frank himself was allowed the last word. He spoke once more on his own behalf, unsworn this time also, for five minutes, denying the testimony of others that he had known Mary Phagan by name and that he had gone into the dressing room for presumably immoral purposes with one of the company's other employees.) The jury that convicted Leo Frank Three Confessions It is important to understand that Leo Frank's startling admission of his presence in the death room at the critical moment did not stand alone in the jury's eyes. Conclusive as it was, it was not Frank's only confession . The official record shows Leo Frank confessed to murdering Mary Phagan three times, though he would deny all three. James Conley o Confession Number One - April 26, 1913: Leo Frank's murder confession number one was made to Jim Conley when Leo Frank told him he had tried to "be with her" (have sexual intercourse with Mary Phagan) and she refused him. According to Conley, Frank then stated he had hit her, knocking her down, then adding "I guess I struck her too hard and she fell and hit her head against something." Some of Mary Phagan's bloody hair was discovered on Monday, April 28, 1913, by Robert P. Barret on the handle of a lathe in the second floor Metal Room. o Confession Number Two - April 26, 1913: According to the McKnight family, Leo Frank confessed to murdering Mary Phagan to his wife Lucille Selig Frank on the evening of April 26, 1913, at around 10:30 pm, saying to his wife that he didn't know why he would murder - and asking his wife for his pistol so he could shoot himself. Lucille reportedly told her family, and her household cook and cleaning lady Minola McKnight, about what happened that evening. Minola McKnight told her husband Albert McKnight, and full documentation can be found in State's Exhibit J (see the Appendix to this article). Decades later, Lucille Selig Frank refused to be buried in the Frank family plot next to her husband, leaving explicit instructions to the contrary. o Leo Frank Murder Confession Number Three - August 18, 1913: This is the "unconscious bathroom visit" statement delivered by Frank to the court in his unsworn statement, placing him unequivocally at the murder scene at the critical time. Frank would also reaffirm this admission in a newspaper interview published by the Atlanta Journal-Constitution on March 9th, 1914. With Mercy - or Without? Judge Leonard Strickland Roan gave the jury two options if they found Leo Frank guilty of the crime of murder: 'With Mercy' or 'Without Mercy.' If there was any doubt of Leo M. Frank's guilt, the judge and jury could have sentenced him to life in prison instead of sentencing him to death by hanging. When the jury unanimously sentenced Leo Frank to death by hanging after deciding on a verdict of guilt, Judge Roan had the legal option to downgrade the jury's death sentence, and only give Leo Frank life in prison - that is, if Roan disagreed with the judgement. But Judge Roan agreed with their collective verdict and recommendation. Judge Leonard Strickland Roan Many in the Jewish community, and other Leo Frank partisans, have suggested that Judge Roan doubted the verdict because of one of his apparently appeasing comments made orally to his former law partner, Luther Rosser. But if Roan actually doubted the verdict, he could have exercised his power many times to prevent Frank's execution, and even given him a new trial if that would have served the cause of justice. But he did none of these things. You are Hereby Sentenced to Hang on April 17, 1914; Happy Birthday Certainty of Leo Frank's guilt was so strong that - after reviewing his trial testimony for months, and after the Georgia Supreme Court's majority decision upheld Leo Frank's conviction and the fairness of his trial - Judge Benjamin Hill, on March 7, 1914, sentenced him to die on his 30th birthday : April 17, 1914. Only absolute mathematical certainty of guilt warrants such a cruel sentencing date by a judge. * * * Appendix: Essential Reading To gain a full understanding of the Leo Frank case, and the tissue-thin "anti-Semitic conspiracy" theories advanced by the media today, it is necessary to read the official record without censorship or selective editing by partisans. Rich people rarely tell you how they really feel about poor people. Occasionally, though, you get a glimpse. Earlier this week, the Washington Post published a story about Rancho Santa Fe, a small but extremely wealthy enclave in Southern California. Like the rest of California, the people of Rancho Santa Fe are dealing with a drought. As you might imagine, that means water is scarce and conservation is critical. For the denizens of Rancho Santa Fe, however, conservation is someone else's problem, namely poor people. According to Steve Yuhas, who lives in the area and hosts a conservative talk-radio show, privileged people "should not be forced to live on property with brown lawns, golf on brown courses or apologize for wanting their gardens to be beautiful." Oh, the humanity! In case it wasn't clear, Yuhas added that the right to water ought to scale with income: "No, we're not all equal when it comes to water." And Yuhas isn't alone. Gay Butler, an avid equestrian and fellow resident of Rancho Santa Fe, fumed for similar reasons. "It angers me because people aren't looking at the overall picture," she said. "What are we supposed to do, just have dirt around our house on four acres?" Perhaps Butler has a point. It's one thing to demand sacrifice in extraordinary circumstances, but we've got to draw the line somewhere, right? If a woman wants to ride her finely manicured horse on a dirt-free prairie in the middle of the desert, what matters a little drought? Brett Barbre, a fellow Orange Country aristocrat, also appears to get it. "I call it the war on suburbia," he remarked. "California used to be the land of opportunity and freedom. It's slowly becoming the land of one group telling everyone else how they think everybody should live their lives." Barbre continued: "They'll have to pry it from my cold, dead hands." You may be asking yourself: Do restrictions on water consumption during a historic drought really constitute an all-out assault on human freedom? Fair question. Most of us fail to see this issue in such grand terms. Maybe we're missing something. Mr. Barbre is either a bold lover of liberty or a detached plutocrat with a penchant for hyperbole. You be the judge. In any case, I see the decadence of the people in Rancho Santa Fe as a microcosm of America today, particularly corporate America. What these people exhibit, apart from their smugness, is a complete absence of any sense of collective responsibility. They can't see and aren't interested in the consequences of their actions. And they can't muster a modicum of moderation in the face of enormous scarcity. Every resource, every privilege, is theirs to pilfer with impunity. These people are prepared to endanger an entire ecosystem simply to avoid the indignity of brown golf courses; this is what true entitlement looks like. The wealthiest Americans - and their apostles in government - tell us that it's the poor people who are entitled, who take and exploit and keep more than they deserve. But that's a half-truth, and a dangerous one at that. Entitlement has many faces, the most destructive of which is on display in Rancho Santa Fe. These adolescent upper-crusters are entitled because they believe they have a right to everything they can get hold of - regardless of the costs. They believe living with others carries no obligations. Anyone who places their right to pristine golf courses above their responsibility to respect communal resources is a social toxin, a privileged parasite eating away at the foundations of society. It's important that their actions be seen in this context. http://ift.tt/1eDrA1U

Racer Crashes While Celebrating Victory

As the eurozone heads into day two of its critical week of Greek bailout talks, it's clear that it's not only Greeks who are feeling the pressure. In Paris, which saw thousands march over the weekend to support Greece, some feel that being a part of Europe comes with responsibilities for everyone. "When we decided to create Europe, it supposed to have an idea of solidarity," explained Parisian Pascal Bazea. "Now we should show this solidarity, and prove it:" "On the news this morning I understood that we are heading towards an agreement. I think this is positive," said Paris resident Diane Monnier adding, "I think the Greek debt must be cancelled to help the country to recover." These views stand in stark contrast from the rhetoric from many EU leaders. German officials have warned Greece that they would have to leave the eurozone if they fail to do a deal. A tactic which Berlin resident Rainer is not at all happy with. "The German government must stop destroying Greece. This is not just about Greece but also about Spain. When they (Spaniards) go to the polls we might finally get a different Europe. To me, it seems we have forces within the EU who are not interested in saving Greece but simply in doing away with a leftist governments." "I am definitely of the opinion that we should try to keep Greece in the EU," said pensioner Gisela Hauff. "Germany is a rich country and we invested a lot of money, including us individual citizens. We hardly get any interest on our savings anymore". Europe's grand unifier, the single currency appears to be uniting many on the streets of Paris and Berlin in the opinion that a Grexit must be avoided at all costs.

Another mass shooting, another round of arguments about why gun reform is doomed to fail. Turns out, most of those arguments don't hold up to scrutiny A majority of US senators voted for a package of gun control measures only two years ago. The 54 who backed the bill, which was written by Republican Pat Toomey and Democrat Joe Manchin, included three other Republicans. But when four Democrats got cold feet about their electoral chances in the midterms, the legislation fell short of the 60 votes it needed to prevent a filibuster. Heading into the 2016 election, however, there are many more moderate Republican seats up for grabs - and a meaningful opportunity for Democrats to take back control of the Senate. A successful bipartisan Senate bill and more persuasive president could be enough to encourage a future House speaker to allow a vote, too, or at the very least put pressure on the Republican-controlled House. Myth No2: Americans don't want meaningful gun reforms Roses with the faces of the Sandy Hook elementary students and adults killed are seen on a pole in Newtown, Connecticut, in 2013. Photograph: Timothy A Clary/AFP/Getty Images Support for universal background checks skyrocketed after the December 2012 Sandy Hook elementary school shooting in Newtown, Connecticut, with 90% of Americans behind the proposal at its peak. More than two years later, polls continue to show strong support for expanding background checks, averaging 80%. As a successful 2014 ballot initiative in Washington state proved, if you leave the decision in the hands of voters, they are more likely than politicians to vote for universal background checks. Ironically, when Congress was weighing air strikes in Syria in August 2013, just four months after the failed background checks vote, one of the foremost reasons lawmakers cited in opposing the Obama administration's plan was polling that showed 90% of Americans were against intervention. It was a classic example of how Congress selectively listens to the American people - as in, whenever it's more convenient. Myth No3: Gun control won't stop gun violence There are more than three times as many Americans killed by guns per capita than in any other wealthy country, and more than 10 times the rate in comparable larger countries such as Britain, France and Japan. Many of these countries have similar problems with crime, drugs, urban deprivation and youth violence, others are more peaceful, but there is one simple thing that countries with less gun violence have in common with each other: they have fewer guns. No one can predict the future of a more gun-constrained America with certainty, but the evidence from dozens of comparable societies points to a clear causal relationship between access to firearms and how often they are used. Myth No4: Switzerland and Israel seem to do OK without gun control Switzerland is known for widespread gun ownership but not for gun deaths. Photograph: Fabrice Coffrini/AFP/Getty Images Proponents of unfettered gun ownership often point to the example of Switzerland, which has a tradition of more widespread firearms ownership than most other European countries but is not known for its gun-ravaged inner cities. One problem is the trend is not that different: more guns still lead to more shooting, just less so than in America. Switzerland is actually second among wealthy countries in terms of annual gun deaths (0.77 per 100,000 of population in one recent survey, versus 2.97 in the US and just 0.07 in England and Wales) but has barely half as many guns per 100 people (45.7 versus 88.8 in the US). But even this comparison gets weaker if you look at the way the Swiss keep their guns, which stems from a tradition of military service that has been considerably tightened over the years. One US study by the National Institutes of Health points out that both Switzerland and Israel (another alleged exception to the rule touted as proof that guns don't kill) actually limit firearm ownership considerably and require permit renewal one to four times annually. Those are just the kind of gun control measures, in fact, that second-amendment fans in the US claim wouldn't make any difference to gun violence. Myth No5: Other countries are different Further rejoinders to the international-comparison argument are less empirical still, tending to rely on a mixture of American cultural exceptionalism, pioneer spirit and a history of racial tension to explain why murder rates are so high without blaming gun ownership. While it is true that US history differs greatly from European history, this theory is less effective at explaining similar disparities with Canada and Australia. Comparisons between similar large cities also belie the argument that there is something uniquely violent about America's urban poor. London has gang violence, drugs and recent riots that make Ferguson and Baltimore look tranquil, yet the Metropolitan police estimate criminals have access to barely 100 guns in a city only slightly smaller than New York. Cities like Glasgow and Liverpool can be shockingly violent places but victims of knife attacks and beatings tend to survive. It may be true that the link between guns and a culture of violence goes both ways, but that's hardly a reason not to try tackle both at the same time. Myth No6: US borders are too open Amid widespread concern over illegal immigration, much attention has also focused on the unique geography of the United States. It is true that the country has among the longest land borders in the world and is a very open international trading nation. It is hard to imagine, however, the weapons would be anywhere near as easy for criminals to obtain if they all had to be smuggled through ports, airports or across the Mexican border. Even a small reduction in weapons falling into the wrong hands would also reduce the incentive for homeowners to store guns for self-defense. Whether US port security or land borders would really prove that much more porous than other countries with stricter gun laws is also open to question, but it is strange this argument is rarely offered as a reason to give up on drug interdiction, or intercepting terrorist bomb threats. Myth No7: Guns are essential for self-defense The NRA president, Wayne LaPierre: 'The only thing that stops a bad guy with a gun, is a good guy with a gun.' Photograph: Steve Ueckert/AP "The only thing that stops a bad guy with a gun, is a good guy with a gun," the NRA president, Wayne LaPierre, infamously declared after the Newtown shooting. According to the nonprofit Violence Policy Center, there were just 258 "justifiable homicides" involving civilians using guns in 2012, as opposed to 8,342 criminal homicides committed with a firearm. "For every justifiable homicide in the United States involving a gun, guns were used in 32 criminal homicides," the group said in a report, which is based on data from the FBI and Bureau of Justice Statistics. And those figures do not even include an estimated 22,000 suicides and accidental shootings annually where guns are involved. Myth No8: The NRA is invincible After Newtown, anti-gun violence groups actually raised more money. According to filings with the Federal Election Commission in 2014, gun control groups declared $21.3m in contributions since the November 2012 election, whereas gun rights groups raised $16.3m in the same period. Americans for Responsible Solutions, the anti-gun violence group co-founded by former congresswoman Gabby Giffords, a Democrat who was shot in the head during the 2011 mass shooting in Tucson, Arizona, amassed a whopping $11m in its first four months of existence. Myth No9: Lawmakers will be voted out of office for supporting gun control In the 2014 elections, two governors who passed comprehensive gun control bills - the Connecticut governor, Dan Malloy, and Colorado governor, John Hickenlooper, both Democrats - were re-elected despite the NRA's best efforts to defeat them. The gun control debate also had little effect on lawmakers who voted against stricter gun laws after Newtown. US senators Mark Pryor of Arkansas and Mark Begich of Alaska - two of just four Democrats who joined Republicans in blocking a Senate bill to expand background checks - both lost their re-elections anyway. Despite its pledge to reward politicians who stood up for gun rights, the NRA did nothing to help either senator. Money and grassroots support is also now on offer from groups like those backed by the former New York mayor Mike Bloomberg, that support gun control. Myth No10: Mass shootings still happen in areas with strict gun laws, so gun control doesn't work When a mass shooting occurred in Septemberg 2013 at the Navy Yard compound in Washington, one of the first arguments made by activists for gun rights was that gun control is clearly ineffective because DC has some of the strictest gun laws in the US. A similar point has been made about Chicago, which has tough restrictions on guns but ranks among the country's deadliest with respect to gun violence. The problem with this theory is that criminals also have access to cars, and can easily obtain firearms in neighboring states or counties. In the Navy Yard incident, the shooter legally purchased firearms in neighboring Virginia despite a criminal record and mental health issues - exposing gaps in the current background checks system. And cities like Chicago are plagued by the illegal trafficking of firearms; there is no current federal law that defines gun trafficking or straw purchasing as a crime. Myth No11: Universal background checks would create a federal database of gun owners One of the myths that ended the background checks bill in the Senate two years ago was the claim - perpetrated by the gun lobby and swallowed by most Republicans - was that it would create a national registry of gun owners. In fact, the Manchin-Toomey legislation explicitly barred the creation of a federal database in its text, but opponents insisted it would infringe on the liberties of gun owners in America. Aside from that being a false claim, it was notable that just a couple of months later, when it was revealed that the NSA was spying on millions of Americans, the same lawmakers were overwhelmingly supportive of far more intrusive data-gathering. c/o Guardian us-news/2015/jun/20/charleston-south-carolina-shooting-gun-control-reform-myths & The Trews
