This is the full transcript. Secretary Clinton received $225,000 for this speech. The speech has not been confirmed or authenticated. CLINTON: Thank you. Thank you so much. Thank you very much, Lloyd , and thanks to everyone at Goldman Sachs for welcoming me today. I'm delighted to be back among friends, colleagues, collaborators, supporters, kindred spirits... Let me jump right in. You know, over the past few months, there have been popular concerns about an economy that still isn't delivering for the majority of Americans. It's not "delivering" the way that they feel it should, that they feel entitled to. Most Americans that you speak to, speak a populist rhetoric that claims it is stacked for those at the top, that those of you here have it too good. (Laughter) But we know the hopes that the little people have for their future - things like school, job, food, clothing on their backs- all of those little things would not be possible without your leadership and innovation. Since the time of the Medicis, even before, and the financing of the first joint stock companies in the transatlantic slave trade, we know that finance and banking is what makes our capitalist economy not just grow but tick... Previous generations of Americans built this economy and a middle class on a collective illusion: that they do productive work, this creates wealth, and that this builds the economy. We all know how misguided that is. We know that it's really due to your investing, credit, and economic stewardship, that they have been able to work at all, that they are able to put food on their tables. It's due to you and other banking, trading, investment houses that we have an economy that works at all. You are why we are a truly 21st century economic power. (Applause) You, Lloyd, and your colleagues, have been instrumental in that. People say you are overpaid or even parasitic, parasites on the economic body, and they quote a long line of seemingly "unethical behavior". They equate with you everything that is wrong and immoral with Capitalism, they charge that you have acted ruthlessly and unethically, "rigging every major market bubble since the Great Depression". (Hissing) But I-contrary to populist, hysterical demonizing-firmly believe that what you do is essential and critical: you help allocate our investment, direct our economic development, hedge risks, and create power, policies, and alliances in ways that make our country stronger, richer, more powerful, more innovative, competitive, and yes, more "democratic". You underwrite our elections and our political process-taking on the huge cost of enabling democratic dialogue at its biggest, broadest capacity. Your tireless work adds true value, and without you, we would still be struggling helplessly against industrial powerhouses in Asia and across the world trying to compete with them on the level of industry, technology, innovation, and hard work, at which they would beat us hands down. It's your financial innovation, your speculative tools, which allow us new ways of creating value without sweat or struggle, that gives us the competitive advantage. It's this vision, this technological innovation, this financial wizardry, this is what makes America great and powerful. (Applause) For decades, people have argued that if we give more wealth to those at top by cutting taxes and letting you and other corporations write the own rules, it will trickle down, it will trickle down to everyone else. And it has! My speech here is an example! (Cackles, Waves Check) (Laughter). But seriously, I believe that the work of Goldman Sachs is critical for us, and without you, America would be a faint shadow of its current greatness. Your work in innovating finance, in creating new sources of wealth and investment, your tireless efforts stimulating the creation of new financial instruments, in lobbying politicians, in monopolizing the treasury and cabinet, in setting and binding the parameters of financial regulation that allows fluidity and flexibility in investment and speculation, this allows us to create wealth-almost out of thin air. It's this alchemy, this genius, this Midas touch-which is one of the most under-appreciated and under-acknowledged contributions in modern economic history. (Applause) It's fair to say that you have transformed the solid, clunky, friction-laiden trading of traditional commodity speculation into responsive, intelligent, liquid flows, that have vaporized every barrier and transformed into an expansive, responsive, endlessly expanding gas that fills every atom of our productive economic space that generates immeasurable value everywhere it goes, and everything it touches. Who cares that it's a little chaotic or "unethical"? That it seems tied to every financial scandal and crisis and economic catastrophe in history? Not me. "Creative Destruction" is all part of the game, and you are masters of it. (Applause) Some will say that you are simply parasitic on those who labor at menial physical production-these are people who still subscribe to 18 Century notions of value production-and that you skim off profit without doing anything meaningful or of value. Those people are misguided: we know that if money never sleeps, that's because you keep it awake! You have-if I may use a metaphor-injected money with caffeine, Adderal, crack, meth, with LSD so that it can dance the crazy dance and grow a crazy thousand psychedelic feet tall in a rainbow minute! Money was a lazy b*tch, until you put it to work! And look how it works! Look how it grows! Materializes out of nowhere! (Waves check again, dances, cackles). Some people have said that it was your irresponsible financial engineering, risk-taking, and profit-seeking, that led to the 2008 crash; that you shorted your own toxic mortgages in the most brazen securities fraud in financial history, dynamiting and imploding the global economy; and that the exorbitant bonuses paid from tax payer money, the financial bailouts, the non-prosecutions created moral hazard, rewarded avarice, incompetence, corruption and vice. You and I know it is nothing of the sort. As leaders, innovators, captains of finance, you will always be subject of the jealous resentment, the petty tantrums of the unwashed masses, the insolvent, the irresponsible, the invidious, the losers. They will envy you, your successes, they will despise you, but they secretly want to be like you! (Laughter) As you know, my husband tried very hard to change the culture of this misbegotten underclass, by kicking them off the government teat, by poisoning their milk with harsh, bitter regulation, and by disciplining them with the most arbitrary, racist, punitive, devastating criminal laws in US history, laws which Richard Nixon, the Southern strategists, the slave catchers, could only have dreamed of. He also passed NAFTA, which told them in no uncertain terms that they needed to discipline themselves as workers, and learn to be competitive in the global sweatshop, or face certain extinction. But they have not learned their lesson. (Hissing) The effects prove themself. Under President Clinton - I like the sound of that!- America saw the longest, most prodigious reaming of the undesirable classes in our history, putting them firmly in their places. And they loved it! He felt their pain! And relished it! Because he was inflicting it! (Applause) And I will too! (Applause) Now today - today, another capitalist crisis looms, bigger and more dangerous than 2008, and again we hear sentimental cries for populist reform. I believe we have to stave off these demands to reform the banking and the financial system, and restructure the economy more equitably. You can't build an economy without the smart people-the Titans and Gods of Finance-like you-to direct the economy, and for the smart people to do their work, you need to be rewarded for your efforts, and you need a free hand to exercise your brilliance. (Applause) Books like "The Spirit Level" and organizations working for equality, certain politicians, spew a ridiculous myth of populism and the benefits of equality. But the fact is, we can't create profitable businesses without exploitation, and we can't grow the economy without speculation and inequality, and we certainly can't boost our economy into the stratosphere without allowing you to exercise your amazing financial intelligence and acumen in fiscal number-crunching, speculation, numbers-running and fraud! (Applause) Just think of this: can you imagine a football game without gambling? It would be dull, mind-numbing-who would watch steroid-addled jocks rut and slam into each other mindlessly without having put down money on the outcome? Who would pay the huge salaries for these vapid idiots? It's only because you have bet on the outcome that people become excited about the sport: it becomes life-and-death-thrilling! It becomes paint-your-face-get-shit-faced exciting! Act-stupid-exciting! That's what you do: you add excitement, thrill, value, and enthusiasm to the dull, dirty job of growing the economy, you make the game exciting, sexy, which draws more money into the game, the casino, that expands the excitement, grows the customer base, develops the economy, and that's priceless! You speculate, stimulate, titillate, dynamize, satyriasize the entire economy! I am such a fan! Go Goldman Sachs! (Does little cheerleading number, complete with hand gestures) Gooold-Maaan-Sachs! (Applause) Let's tell the truth: America is struggling-despite the endless fabrication about "the recovery"- because we are not yet running the way we should. Banks are still over regulated. It's over-regulation that creates financial catastrophe! Despite your huge paychecks and squirreled away assets, I know that you are worried: worried that some "socialist" demagogue might come along and confiscate it all and put you all in jail. With president Obama, you were in good hands: he's one of us. (Good thing you ponied up $981K for his campaign). He took good care of you, had your back, covered your financial rear. But populist sentiment is rising up again, more strongly than before, and the unwashed masses are full of resentment, anger, jealousy. They are angry that they don't have jobs, that they are in debt, that they can't scrape a living together, even though they are working, 2,3,4 jobs to put shelter over their heads. That their children are starving. That they cannot see a light at the end of the tunnel. They are angry about the 100 million people driven into the brink of starvation and the global food riots that they claim you caused with your commodity futures speculation. The $5Trillion of value lost from the markets that they claim you collapsed. The millions who lost their homes and are now on the verge of homelessness. The trillions funneled to you in loans, write-offs, bribes to keep the system going. Even when I was working for Barry (Goldwater), I felt that same irrational resentment. Now it's at an all time high. Irresponsible single mothers, uneducated immigrants, lead-drinking ghetto-strutters, homeless, crying, babies, starving senior citizens, obnoxious, entitled African Americans who object to having bullets pumped into their bodies by police: all these people are angry, entitled, and making noise, and they are endangering our democracy and economy, our greatness. (Hissing) I hear this everywhere I go. A single mother, with three children-wants to go to college, find enjoyable, well-paid work and also enjoy the emotional luxuries of motherhood-all at the same time. Everyone feels entitled to everything. She even wants housing. Now even I couldn't do all these things, despite my incredible privilege and intelligence. But they want it all, now. Three children? (Booing) A grandmother, playing with children-it makes her happy like a cow, but she still feels entitled to be paid. Because she wants to feed her drug habit, she wants to sell them for more money....she wants it all! (Booing) A student, with an unmarketable degree in women's studies, specializing in medieval feminist villanelles, wants debt forgiveness, and a high-paid job putting her non-existent skills analyzing romance language texts to use and profit in a rewarding cause. She also wants a pony, a sensitive but dominant lover, a villa on the Riviera, and World Peace! (Cackles). (Laughter) Millions of working sad-sack Americans have similar fantasies. They want more money. More pay. Decent wages for hard work. They think it grows on trees. They think that money will grow and nuzzle up to them in their sleep, when they have no money-appeal. They think they can tax Other People's Money to get what they want. They don't realize Money has to be jacked up the ass, stuck in the veins with meth, dragged out and pimped to make more! You have figured out how to make your money work, turned it into a profit-generating prostitute! The future expected earnings of a profit-generating prostitute! That you've shorted! These people, idiots, all of them, they expect money to come to them! Without Scheming! Without reaming others! By working hard and being good! Like puppies and ponies! Like flowers after a downpour! Like the lilies of the valley! Like utopian visions of a drug-addled socialist! (Laughter) Wages need to be kept down, and people just need to work harder. Damn harder. At least as hard as Bill worked to keep Haiti down. (Applause) We must lower incomes for low-value working schmucks, so they give up on any notions of a middle-class life. But more than that, we must reduce the slick, unsustainable bigotry of expectation: the profit-sucking cage of entitlement, expectation, and imagination. We must drive income down steadily and siphon that surplus wealth to you, the captains of finance, so that we can build a strong economy that is innovative, powerful, that acknowledges and rewards your acumen... (Applause) And that will be my mission, from the first day I am president to the last. I... (Applause) I will get up every day thinking about you, the hard-working Wizards of Finance, Lords of Capital, Economic Giants of Innovation, Noble Titans that make us strong and powerful! (Applause) I came from a petit-bourgeois family with a drapery business that exploited workers to give me good middle-class life, a first-class education, and my incorrigibly elitist beliefs. It put me on third base, instead of striking out. As I try to steal home, I will be thinking about all the Wall Street bankers that I represented in New York and the "advice" that they gave me, and I will work with them-for you- to give them the maximum freedom to do what's best for them. Because what's best for Wall Street is what's best for the US. What's best for Goldman Sachs is what's best for the planet. I promise to take on this challenge against the clamoring, whining, agitating babies demanding for major changes in our economy and the global economy, demanding for equity and justice. These demands are stupid beyond belief. (Laughter) As you know, advances in financial technology and global trade have created new areas of commercial activity and opened new markets for our exports. Too often policy wonks want to resort to protectionist measures because they don't realize that these treaties are designed to suck wealth out of the third world and suck it into your portfolios. These people suffer from a lack of big-picture thinking. They believe that they are still going to be building widgets in a factory if it were not for the 1 billion Chinese stealing their jobs. They don't understand that we are sucking the lifeblood out of both of the Chinese and all workers-the vampire squid with the blood funnel-creating value, wealth, growth! (Cackles) Today's marketplace focuses on the short-term, instantaneous financial trading, and short-term earnings reports, and that's just how it should be. Those who are struggling need to rent out their living rooms, garages, bathrooms, dog houses, sell trinkets on EBay, sell themselves, their time and their bodies in the gig economy. All of this creates exciting, dynamic extra wealth, which should go to you, the geniuses of the universe, because you are the ones driving this with your investments, speculations, deregulation, policy capture, and of course outright bribes. There's no problem that a little more liberalization and deregulation can't make better! (Takes out check and cackles) But all of these trends are temporary, and artificial, and unless we push really hard to make them happen, they won't continue. The choices we make as a nation matter. The choices we make will set the stage for what American life will be like in this 21st century: will we have a nation of namby-pamby socialistic commies whining and demanding every little privilege while our nation crashes down around our ears, and we are reduced to becoming serfs for the Chinese? Or will we have a powerful country, bristling with guns and weapons, capable of putting everyone in their place? Capable of invading countries on a whim? Of unleashing chaos and violence gratuitously? Of violating a leader's body orifices with sharp objects with impunity? (Cackles). Of manipulating the world economy on a dime, without sweating any labor? (Applause) As president, I will work with you to turn the tide of populism, to make these currents of change infeasible, impossible. We don't hide from change; we subvert, hijack it, appropriate it. (Applause) But it will take money. Lots of it. This is a good start. (Waves check again, smiles, coyly). The measure of our success must be how much incomes rise for you, the elite, the 0.0001%, not some just arbitrary growth targets tethered to people's unwarranted and undeserved notions of "equity", and "justice". (Applause) I want to see our economy work for the top, the leaders, the Gods, the Masters of the Universe like you. We're not going to find all the answers we need in the playbooks of the past, we can't go back to the policies of social equity that failed completely... Today is not 1968. The sixties are so over. And it's not 1917. The Bolshies are so over. It's not 1789. No more liberty, equality, fraternity. No more freedom fries. Non Merci! ca suffit! People need to accept the fact that finance capital is a reality, that the interests of the capital markets drives the world, that it can't be turned back, and that it's the final solution for all the challenges we face now, including the unending catastrophes that it's creating, including the burning, fiery apocalyptic end of the planet. So today, I'm proposing an agenda to give you what you deserve, an agenda for unlimited financial deregulation, growth, wealth accumulation and concentration. It's the least we can offer you given the undeserved contempt and abuse you've suffered over the past years. More concentration means more jobs and more new businesses catering to you. More jobs give people more opportunities to service you, toady up to you, vampire squid and all. (Waves check suggestively). Full employment is completely unnecessary, so 19th Century; the desperation of potential unemployment keeps people working hard to keep their jobs, so their productivity and toadying should be absolutely top notch! No more disrespect! We know that Finance creates most of the wealth in this country, so that has to be THE top priority. Let me tell you straight: I want to be the presidency of, by, for Goldman Sachs, and I mean it. I'll make sure to line my cabinet with your people, like everyone else. Lloyd, name your position! (Wild Applause) And throughout the upcoming campaign, I'm going to be sending lots of dog-whistle messagesabout how to empower you with less red tape, less regulation, less taxes, easier access to free, risk-free money, simplification, easy access to me, all the while talking populist claptrap.... (Takes out dog whistle and blows to utter silence) (Loud laughter) Don't be thrown off by the populist rhetoric. You know that's just how we play the game. You know I'm your gal...a Goldman Sachs gal.... (Brushes check wistfully over lips) (Laughter) Just don't tell anyone what I said.... (Laughter) I'll push for tax incentives to spur speculation, giving you loopholes that you can drive your jumbo private jet or yacht through! Show us how innovative, creative thinking you are! (Wild applause) And I know it's not always how we think about this, but another engine of strong growth should be the TPP and the TTIP, and the TISA. (Applause) I want you to hear this. Creating a global neo-liberal enclosure of the entire world economy that pretends to be about "free trade" won't do much for the total economy-perhaps a tiny percentage point of growth-but I guarantee it will line your pockets like nothing else. Think trillions in your coffers. Quadrillions, once we force all the Asian-Pacific economies to suspend their financial uptightness restricting wild casino gambling! Financial liberalization forced on Asia will result in Quadrillions! Bazillions! And remember, the house-that's us-we write the rules-never loses! (Wild Applause) These are the new policies that will help change the world order. It's not just about these United states, or even the Asia-Pacific that I'm pushing for in the Pacific Pivot. We need to change the planet, before the planet changes us, gets back at us for abusing it so deeply. It's the planetary endgame, and we want to have a big blast before our toys are taken away.... When I get started, we get our country moving in the direction that we want. Money that can channel more public and private funds to the top leadership-that's you and me... (Applause) ... channel those funds to finance and speculation! (Applause) So let's built those faster trading algorithms and make sure they work faster, bigger, riskier, and trade sums larger than they have ever before! (Applause) And really, there's no excuse not to make wilder, greater investments in speculative trading right now. (Wild applause) Our economy obviously runs on finance, and the time is long overdue to make America the ultimate financial superpower. Weapons of financial mass destruction? Bring them on! They are ourweapons! Some may worry Finance may destroy millions of jobs, put billions into penury, kill billions of starvation, send the economy into a crazy tailspin, but it will make us-that's you and me-rich and powerful beyond imagination. Let's be real here. Isn't that what matters? (Cackles) (Laughter) Let's fund the mathematical research that spawns breathtakingly risky trading algorithms and creates entire new areas of fictitious capital, an equation to model every aspect of human greed and fantasy and desire! I can put my support behind that! A mathematical copula that really copulates the unwashed masses! (Laughter) (Wild Applause) I will set ambitious goals in all of these areas in the months ahead. But today, let me emphasize again, that I will institute the key ingredient of strong growth that often goes overlooked... I will break down all global non-tariff barriers so we can do what we did to our economy all over the world. We are equal opportunity crisis-makers! (Applause) Watch what I do, not what I say! (Lifts dog whistle to lips) (Loud laughter) We are in a global competition, as I'm sure you have noticed. I'm starting to repeat myself, but I'm on a roll. We can't afford to leave finance on the benches. That's exactly what we're doing today with Glass-Steagall-type regulation. When we leave money on the bench, we not only shortchange its power, and we lose the game, and we shortchange our country and our future. The movement of hot, speculative money into real estate during the past 20 years was responsible for trillions funneled into your pockets. But that progress is beginning to stall out. Studies show that nearly this decline is happening because we're trying to stop real fictitious growth, considering valorizing people over profits. What an absurdity! We should be making it easier for speculative finance to make money and innovate. To develop bubbles and create trillion dollar valuations out of thin air! And to short them at will! This is how we pump up our economy like a hydrogen bomb! Speculators who want to speculate without limit should be able to do so without worrying that they may find themselves inside a federal resort working on their abs and pecs. You know, last year - (Applause) You know, all this speculation adds up. And for you, it's trillions every day. Now I am well aware that for far too long these practices have been challenged by socialistic demagogues. Well, those days are over. (Applause) Free speculation, and free money, no taxes, and no restrictions, here or anywhere else in the world: this is essential to our competitiveness and our growth and my ego! And I can do this in a way that doesn't alarm or outrage the unwashed masses! As president, I'll fight to put you first, just like I have my entire career. Just remember the dog whistle! (Lifts to whistle to lips) (Laughter) Just watch! (Applause) The trader who stands on his feet all day, shrieking his heart out, or the quant who is driving his synapses into overdrive trying to make an unforgiving algorithm match the fluctuations in a chaotically fibrillating market, or the hedge fund manager, who has loses sleep over the global economy, these people do not need regulation! They do not need a lecture! They do not need the planet's animosity. They need more rewards, for the hard, crucial, essential, brilliant, world-changing work they are doing! (Applause) The truth is the current rules for our economy do not reward financial risk-taking enough. r (Applause) Alongside gutting taxes, it's time to stand up to efforts across our country to restrict the power of finance, which has been proven again and again to destroy an economy, and make you sad....Socialist demagogues like Elizabeth Warren and Bernie Sanders have made their names stomping and vilifying you.... (Hissing) I will fight back against these mean-spirited, misguided attacks. But I will do with subtlety and finesse and subterfuge! Just like when I was a Goldwater girl! Now I'm a Goldman Sach's girl! (Rubs check suggestively) (Laughter) In the years leading up to the "crash", financial firms innovated risk away, but regulators in Washington either could not or would understand this. I was alarmed when they took the punchbowl away. The current President Obama gave you and your colleagues 17 Trillion of free money, and endless zero-rate loans, but he still had to pretend to take you and your colleagues to the woodshed. Dodd-Frank. Sarbanes-Oxley. The return of Glass-Steagall. Other annoying, pesky legislation and regulations. Too many of you are bound and wrapped in red tape: shadow banking, money laundering, hedge funds, high-frequency trading, non- bank financing, interest rate manipulation, all done in the shadows, because of vicious, irrational regulations that marginalize and oppress you. (Hissing) Even when you have already pocketed the gains, and gotten away scott-free, there is social approbation, contempt, and this is painful, this is wrong. I feel your pain! On my watch this will all change. Over the course... (Applause) ... over the course of my campaign, I will offer plans to unleash your endless creativity and risk-taking. I will make sure that you will not pay the price of those risks: I want to encourage you to take them. Just as limited liability allowed early capitalism to grow, back-stopping your risks will be my charge and duty. We'll make sure that Wall Street and stock markets explode in growth for you! Profits for you! We will assume the Risks! For you, the financial innovators! Captains! Lords! Titans! Gods of finance! I will appoint you to every regulatory position of power! Too big to fail is too big not to give control over the entire government! (Applause) I will ensure that no one will ever be prosecuted. Those who shout for decriminalization of drugs fail to understand that decriminalizing financial crime will bring it out of the shadows into the mainstream economy, boosting it into the stratosphere! (Applause) Government has to be smarter, smaller, more focused on supporting speculative investments than the convenient politics of justice, and be a better servant of the private sector. 27 Feb 2016 - The European Commission is planning to slap down Hungary's decision to hold a referendum on compulsory migrant quotas, claiming that holding a democratic vote would not "fit into the decision-making process" agreed by European Union (EU) states. The quota system redistributes migrants from the most overwhelmed countries, including Germany, Greece and Italy, to EU states that have proved less popular with newly-arrived migrants. The system is extremely unpopular in Eastern European countries, including Hungary, who feel Western Europe is using it to force thousands of migrants on them. Hungarian Prime Minister Viktor Orban now plans to challenge the policy by holding a referendum on quotas that will almost certainly see the plan rejected. However, Euractive reports that the European Commission has questioned Hungary's stance. Spokeswoman Natasha Bertaud said: "We fail to understand how it would fit into the decision-making process which was agreed to by all member states, including Hungary, under the EU treaties." Mr Orban defended his decision in an interview with German tabloid Bild, telling the paper: "We cannot make decisions over people's heads that will significantly change their lives and those of future generations. "The quota would change the profile of Hungary and Europe: ethnically, culturally, and religiously. My decision is not directed against Europe. It is a decision to protect European democracy." He added that the EU's quota system violates its own laws: "This decision is not legal. It contradicts EU law. We are filing a suit against it, and so are the Slovakians. Plus, how many of those 160,000 have been distributed so far? Only a few hundred. This distribution key is nonsense, it does not work. But no one in Brussels wants to admit that." A disposable pawn in a grander game of chess, the EU stands these days at the mercy of a very potent threat: destabilization by mass-migration. With wars raging across the Middle East and North Africa (MENA), the world has grown accustomed, desensitized to the litany of human tragedies: the death, the maiming, the human exodus which terror's armies generated... In blood and on fire, countries were seen to fall to the hands of barbaric militias, the products we were told of regimes' inability to reform their institutions. In light of this ongoing tragedy, I want to discuss the by-product of war - the mass migration the likes of ISIS and its sisters in arms have worked so very hard to manifest, so that their patrons and financiers could wield a new weapon of mass-destabilization, co-opting governments to do their bidding. Please understand that I am referring to migration per se... I am not arguing the validity, rights, or legitimacy of war refugees' plight. My interest here is solely focused on the phenomenon war created, this grand human tragedy which certain powers have weaponized to serve unscrupulous imperialistic ambitions. Mass migration, it needs to be said, has long been exploited by devious entities as part of a new military genre: asymmetrical warfare. In a powerful essay published in Strategic Insights, Kelly Greenhill defined such a tactic under "coercive engineered migrations," noting: "those cross-border population movements that are deliberately created or manipulated in order to induce political, military and/or economic concessions from a target state or states." Elaborating on her theory she went on to add: "Coercive engineered migration is often embedded within mass migrations strategically engineered for dispossessive, exportive, or militarized reasons. It is likely, at least in part as a consequence of its embedded and often camouflaged nature, that its prevalence has also been generally under-recognized and its significance, underappreciated. Indeed, it is a phenomenon that for many observers has been hiding in plain sight." Ms. Greenhill's insight certainly puts Europe's refugee crisis under a very different light. Of course the covert nature of such a manipulation takes nothing away from the intrinsic reality war refugees are experiencing as they seek refuge, and asylum away from the canons, and the bloodshed. Hiding in the shadow of a very real human tragedy, stand war profiteers and puppeteers. Ludicrous you say? Impossible you argue? Let us look at Turkey and its president's warning to Germany of a refugee invasion should Berlin fail to "play" the dutiful ally in the Middle East. Has anyone noticed how quickly the German Chancellor went from a there will be no direct intervention in Syria, to a let's throw military caution to the wind and commit whatever, for however long it takes, regardless? Murat Yetkin, a columnist for Hurriyet solved that political disparity in December 2015 when he noted the convenient timing of Chancellor Merkel's volte face in Syria. He writes: "The increase in military cooperation within NATO countries against ISIL and the piling up of NATO forces near Turkey's border with Syria take place in parallel with the recent deal between Ankara and the Brussels over Syrian refugees and the re-activation of Turkey's EU accession bid." Coincidental? I think not. I believe the right word is coercion. Faced with a refugee deluge, the EU is being simply co-opted in doing some powers' bidding. But what powers, and whose bidding? Here is one theory: the United States of America - the neocon state by excellence, the ultra-liberal in democratic clothing. As Washington continues to push for the fragmentation of the Middle East to better rise a supra-national superpower (or so it thinks) would it be that far-fetch to imagine the US would coerce its "allies and partners" into political and military submission? Have we forgotten how systematically and thoroughly the US spied on EU officials in the name of control? Andrew Korybko recently made an inspired observation when he pointed to Erdogan's refugee chess game in Sputnik this February. He writes: "The recently released minutes from a November meeting between Erdogan and the EU prove that the Turkish strongman is manipulating the immigrant flow into Europe for strategic ends." "We can open the doors to Greece and Bulgaria anytime and we can put the refugees on buses," President Erdogan told EU officials last November. Who is playing whom now? Here is a twist though: while the US might for now sit as chief orchestrator, we ought to remember that money could still unbalance this equilibrium, in which case Saudi Arabia might soon rise as a main stake holder ... and then what? So while Westerners are busy demonizing all foreigners, maybe the real threat lies not with refugees per se, but the games of covert destabilization so-called friendly nations are waging against their governments. Ireland looked set to kick Prime Minister Enda Kenny's coalition government out of office with no clear alternative in sight, according to an exit poll after Friday's general election. The poll commissioned by the Irish Times newspaper said Kenny's centre-right Fine Gael will win but junior partners Labour will fall short of the votes they need for re-election. Michael Martin's centre-left Labour party has been shedding support and was expected to suffer heavy losses, while Sinn Fein, lead by Gerry Adams was expected to make big gains. Left-wing Sinn Fein has already seen a near doubling of support since the last vote leaving it jostling with centre-right party Fianna Fail for the position of second largest party. Political stalemate poses risks for the recovery of Ireland's recently-battered economy. The first of 157 seats were due to be declared on Saturday afternoon with the final winners potentially not decided until early next week.

Albany, NY - The shocking allegations of a racially tinged assault at the University at Albany appeared to unravel Thursday as police accused three black students of making the story up and charged the women with assaulting a fellow bus passenger. The women grabbed national attention after claiming to have been attacked on a CDTA bus around 1 a.m. Jan. 30 by a large group that included white men while others stood by and did nothing.In social media posts that spread like wildfire far beyond campus, the women claimed to have been the target of racial slurs and to have been assaulted while on the bus floor. But authorities now say there's no evidence any of that happened and that the women were the aggressors in the fracas, which was captured by cameras on the bus and other cameras in the hands of bus riders. All three defendants are charged with misdemeanor assault and are facing campus disciplinary proceedings. The actual victim, police said, was a 19-year-old white woman from Congers, Rockland County, who also was a passenger on the late-night route known to students as the "drunk bus." "The evidence shows that, contrary to how the defendants originally portrayed things, these three individuals were not the victims of a crime," University Police Chief Frank Wiley said in a statement. "Rather, we allege that they are the perpetrators." "I especially want to point out that what happened on the bus was not a 'hate crime,' " Wiley said. Ariel Agudio, 20, of Huntington, Suffolk County; Alexis Briggs, 20, of Elmira Heights, Chemung County; and Asha Burwell, 20, of Huntington Station, Suffolk County, were all charged with misdemeanor assault, punishable by up to one year in jail. Burwell and Agudio are also charged with misdemeanor falsely reporting an incident in connection with 911 calls they made to police immediately after the confrontation. The allegations of the three women, including claims that bystanders ignored their cries for help, sparked a large on-campus rally and were held up by some as emblematic of a broader cultural failure to stick up for women of color. The incident roiled tensions on campus and garnered national media attention, including a sympathetic tweet from Democratic presidential candidate Hillary Clinton. Agudio also faces one count each of attempted assault and attempted criminal mischief. Surveillance and cellphone video and eyewitness accounts contradict Burwell, Agudio and Briggs' claims that they were assaulted by white men, who in fact were trying to break up the fight, police said.

Now, lets not criticize the Cops. Keep in mind that they have a job to do and its not up to them to allow the homeless to stay inside BUT where are they going to go at this time and find a warm place where they stay. Money and resources flowing to Islamic State from regional players make it more difficult to fight terrorism, an adviser to Syria's president told RT, adding that the political dialogue has also been thwarted by opposition groups backed by foreign states. " For five years they have not been able to have a dialogue, because each party of this opposition belongs to a different country and is paid by different countries. They are not an opposition that have a political party in Syria and that have grown from the Syrian people. This is the only opposition in the world that are agents of foreign countries against their own country, " Bashar Assad's political adviser, Bouthaina Shaaban, said in an interview with RT. Direct talks between the opposition and the government will be held " whenever the opposition is able to get together and be at the table, " she said, adding that while the government is ready for dialogue, their opponents have so far failed to even agree on their own delegation. "We are running the country according to its constitution... We are fighting terrorism as we should, and we are forthcoming in pursuing any political solution, " she said, adding that both in Syria and Iraq the armies have been " trying their very best " to defeat Islamic State (IS, formerly ISIS/ISIL). However, the interference of some regional players has hampered the success of the process, Shaaban said. "If it were not for the support by regional parties - in particular Turkey and Saudi Arabia, it would not be difficult to defeat ISIL. But the money, the resources, the facilitation comes from these countries to IS," she told RT. Islamic State " doesn't live in a vacuum, " she added, saying that the militants have been receiving support not only from countries in the region, but also "political support of the United States and the West." " There is no such thing as moderate terrorist or moderate opposition, because anyone who carries arms is not moderate, anyone who is killing people is not moderate, anyone who is destroying institutions in the country is not moderate, " she explained, saying that the use of the word "moderate" in this case " has no relation to reality whatsoever." "It's very dangerous, as so many people are using it almost unconsciously... The U.S. and Russia are ostensibly trying to arrange a truce in Syria. As The Daily Mail reported, Israel recently voiced doubts about its success: ...Israeli Defence Minister Moshe Yaalon said he was "very pessimistic" about the truce's prospects. "Unfortunately we are going to face chronic instability for a very, very long period of time," he said. "And part of any grand strategy is to avoid the past,saying we are going to unify Syria. We know how to make an omelette from an egg. I don't know how to make an egg from an omelette." Referring to some of the warring sects, Yaalon added: "We should realise that we are going to see enclaves - 'Alawistan', 'Syrian Kurdistan', 'Syrian Druzistan'. They might cooperate or fight each other." Ram Ben-Barak, director-general of Israel's Intelligence Ministry, described partition as "the only possible solution". This is not the first time Yaalon has reflected on the fractious state of the Middle East. In a 2013 interview, he attributed the developing collapse, not to the disastrous wars of the past decade, but solely to the arbitrariness of the Middle Eastern nation-state's colonial origins: "...in a higher perspective, I would say that, yes, we witnessed the collapse of the nation-state system in many countries. And the nation-state system, to my mind, was imposed in many countries artificially - not in all of them. Egypt is a historic country with a long history, and it will remain Egypt. But countries like Iraq - is divided into, generally speaking, Shia, Sunni, Kurds. The tribes in Libya . . . Syria: its ongoing civil war reflects the rivalry between the Alawites, the Sunnis, the Kurds, which enjoy already autonomy in Syria. And we have to look at it historically, as it was imposed by Western leaders almost one hundred years ago: Sykes-Picot, the end of World War I. We have to look very carefully for our new Western ideas to be imposed on the Middle East." Yet he accentuated the positive. The "savages" have been so thoroughly set against each other, they are too preoccupied mauling each other to pay Israel any attention. "Nevertheless,not incidentally, monarchies survive so far, and artificial states - publics, let's call them - are on the way to collapse, to be divided into sectarian enclaves with political, sectarian differences and violence. . . . generally speaking, Israel enjoys today a relatively calm situation security-wise. The border with Lebanon: peace and quiet since 2006, no Hezbollah provocations. The border with Syria: some problems, because of the internal situation but, generally speaking, a calm situation. Going down to the south, in the Gaza Strip: a couple of weeks with not even one provocation on behalf of Hamas or Palestinian Islamic Jihad or any other faction. Sinai: a quite complicated situation - the last attack was rockets launching toward the city of Eilat. But again, a relatively calm situation. Serving in the military, I don't remember such a calm situation in such a long period of time." Yet, he did strike a note of caution about eventual blowback: "But we have to warn ourselves that what dominates the Middle East is instability. So far, they are engaged among themselves, fighting each other, but it might be, in the end, that the weapons are directed toward us. Anyhow, are well armed - militias, elements, whether Hezbollah, Hamas, Palestinian Islamic Jihad - well armed with rockets, missiles, which is a threat for our security." These reflections must be considered in context of Israeli strategic thinking going back decades. In his "strategy for Israel in the Nineteen Eighties," Israeli official Oded Yinon predicted that: "Syria will fall apart, in accordance with its ethnic and religious structure,into several states such as in present day Lebanon, so that there will be a Shi'ite Alawi state along its coast, a Sunni state in the Aleppo area, another Sunni state in Damascus hostile to its northern neighbor, and the Druzes who will set up a state, maybe even in our Golan, and certainly in the Hauran and in northern Jordan. (...) This state of affairs will be the guarantee for peace and security in the area in the long run, and that aim is already within our reach today." This was part of a more general "Yinon Plan" that called for the "dissolution" of "the entire Arab world including Egypt, Syria, Iraq and the Arabian peninsula." Each country was to be made to "fall apart along sectarian and ethnic lines," after which each resulting fragment would be "hostile" to its "neighbors." According to Yinon, this balkanization should be realized by fomenting discord and war among the Arabs: "Every kind of inter-Arab confrontation will assist us in the short run and will shorten the way to the more important aim of breaking up Iraq into denominations as in Syria and in Lebanon." As I detailed in December, sowing discord among Arabs had already been part of Israeli policy years before Yinon's paper. And David Wurmser, in a 1996 strategy document called "Coping with Crumbling States," argued that "tribalism, sectarianism, and gang/clan-like competition" were what truly defined Arab politics. He claimed that secular-Arab nationalist regimes like Iraq's and Syria's tried to defy that reality, but would ultimately fail and be torn apartby it. Wurmser therefore called for "expediting" and controlling the inevitable "chaotic collapse" of Sykes-Picot through regime change in Iraq. Wurmser himself was one of the key architects of that eventual regime change and subsequent chaotic collapse throughout the region. In general, Israel ideally prefers regime changes that result in the installation of stable puppets. That is Plan A. But Plan B is to balkanize. Better to divide and conquer than to countenance a "rogue" (independent) neighbor. So it is noteworthy that Israel is endorsing its Plan B for Syria just when its enemies are making it plain that Plan A ("Assad Must Go") is not happening any time soon. Israel's jihadi allies in Aleppo are being cut off and encircled, and seem to be on the verge of complete defeat. As the above Daily Mail article quoted: "An Assad victory in Aleppo, Ben-Barak said, "will not solve the problem, because the battles will continue. You have ISIS there and the rebels will not lay down their weapons." (...) "As long as Iran is in Syria, the country will not return to what it was, and it will certainly find it difficult to become stable as a country that is divided into enclaves, because the Sunni forces there will not allow this," Yaalon said in an earlier statement." Have you ever noticed that whenever liberals say that something won't happen, it happens? Yeah, I've noticed that too. Just weeks after Washington State implemented a new nondiscrimination law that protects "gender identity" a man walked into a women's locker room at a public pool in Seattle, a possibility that liberals had pooh-poohed when passing the bill. Other women were shocked because the man evidenced no outwardly feminine characteristics. This was not a dude carrying a purse and wearing a miniskirt; this was a dude who looked like a dude. He calmly began to undress in front of the women who quickly reported him to staff. When he was asked to leave he reportedly said, "The law has changed and I have a right to be here." He later returned at a time when several young girls were changing for swim practice. The police were not called and the unidentified man was therefore not arrested. No surprise there; what would they have charged him with? The law, which opponents claim enables voyeurism, would have been on his side. All he would have had to say is that he feels himself a woman in his heart of hearts. If he had been arrested he would have been able to sue the police for wrongful detention. Such is the insanity of these transgender "rights" laws which completely abandon the idea that maleness and femaleness are objective realities. Those are just social constructs, they argue, and they can be altered with surgery, hormone therapy, or even just a personal decision to be "true" to one's self. In order to muddy the waters they speak of gender rather than sex, two words that were once synonymous but have recently diverged. Even transgender activists acknowledge sex as being determined by biology though they afford it little importance. It's gender that concerns them because gender is entirely self-determined. Nor is gender binary-an "either/or" decision between male and female. Facebook, a company always on the forefront of deviancy, allows its US-based users 51 options for defining gender including "androgynous" and "genderqueer." Said Facebook on its "diversity" page: "When you come to Facebook to connect with the people, causes, and organizations you care about, we want you to feel comfortable being your true, authentic self. An important part of this is the expression of gender, especially when it extends beyond the definitions of just 'male' or 'female.' So today, we're proud to offer a new custom gender option to help you better express your own identity on Facebook." In short, the transgender movement's Big Idea is that no one can tell anyone else what his/her/zir gender is because it's a personal choice. Though completely bonkers, I can see how this idea would appeal to the Left because it rejects the concept of objective reality and fetishizes self-determination. I've often wondered just how far the Left will extend this principle. There must be a bridge too far but where is it? Perhaps that bridge can be found in Ontario, Canada, where transgender "rights" have been the law of the land since 2012. Almost as soon as the law took effect, a man named Christopher Hambrook checked himself into two women's shelters. He had to claim to "identify" as a woman in order to gain entrance but that was easy. He called himself "Jessica" and swore that he was every bit as female as the other residents. The shelters were legally obliged to agree with him. Hambrook proceeded to sexually assault several women which is exactly the scenario that opponents of these types of laws warned of. Surely the law will be repealed now, right? There's no indication that it will be so I guess that even the Hambrook case isn't a bridge too far for liberals. It's just the price we pay for "equal rights." Now I don't really believe that the Left intends these laws to facilitate voyeurism or sexual assault even though that's been the effect. What they want is for men who genuinely feel they are women to be treated as women. (And women who feel like men, of course.) They essentially want everyone to engage in a mass delusion because it makes delusional people feel better. They're still wrong about this. Even if we could filter out the pedophiles and peeping toms from the truly gender dysphoric I'd still be against it because I'd rather not lie to myself. But as a matter of fact we can't filter them out . If each person has full autonomy to decide whether he is male, female, or something else, then each person's stated gender identity is sacrosanct and non-debatable. Guys like Christopher Hambrook can of course be arrested and jailed after they assault women but they can't be preemptively barred from women's shelters as a precautionary measure. Which is utter madness, plain and simple. I can only conclude that in their minds, protecting the delicate feelings of the mentally ill is more important than protecting women and children from pervs. But what can we do about it? My solution is simple: stop using the transgender activists' terms. They're far too subjective and malleable to mean anything at all in a legal sense. I don't care at all what "gender" you "identify" as. I care about your sex. Sex is meaningful because it is an inalterable reality written into our DNA. Might the Left, in deference to the principle of self-determination, be willing to allow us to "identify" as anything we want? Well, almost anything. In 2015, a self-identified biracial woman named Rachel Dolezal was discovered to be entirely white which sparked a nationwide debate about racial identity and whether it's actually fixed at birth. The incident was particularly embarrassing because Dolezal was president of her local NAACP chapter and a world-class race-baiter. Writing in Time magazine, liberal pundit and retired NBA star Kareem Abdul-Jabbar concluded that yes, Rachel Dolezal can be black if she wants to be. Race is complex and illusory, he posits, therefore the race we "identify" with is much more important than the race we're actually born into. It's an exact analogue of the transgender argument transposed onto the racial issue. The only difference here is that the transgender movement differentiates between sex and gender, while race is still a solitary, unified concept. One gets the idea from his article that Abdul-Jabbar will allow Dolezal her blackness because she's been, in his words, a "fierce and unrelenting champion" for black people. I think he means that she's been a racial agitator, which is the same thing in his mind. Dolezal has created or imaged no fewer than nine fake "hate crimes" against herself, the usual modus operandi of black supremacists. But would Abdul-Jabbar be so tolerant of a white kid who claimed to be black on his college application just to take advantage of the lower standards black students are required to meet? I think not, though that sounds like an excellent way to bring the racist affirmative action system crashing down. That "bridge too far" has been identified: it's okay to feign blackness unless you plan to claim the privileges that blacks jealously guard for themselves. Other people who "identify" as disabled are actually doing real harm to themselves. They're called "transabled" and they feel like frauds in their fully functioning bodies. They sometimes cut off arms and legs in order to be true to themselves. Even most leftists, I think, would reject self-mutilation because it's obviously bizarre; but is it really so different than what transgender people do to themselves in order to achieve fulfillment? It's a different body part they're chopping off but mutilation all the same. Can we determine our own age? Don't laugh, at least one gender dysphoric man from Toronto has decided that he is in fact female and six years old . "Stephonknee" (an adopted name) Wolschtt left his wife and seven kids so that he could be himself-or "herself" as media reports tag him. He has been adopted by an elderly couple who treat him exactly as they would treat any six year old girl. He spends his days coloring and wearing dresses. "I'm allowed to be exactly who I am and I don't have to apologize or make excuses because I'm different," said Wolschtt. Of course, neither his maleness nor his age are subjective entities open to interpretation. They are facts. But how could someone who considers "gender" to be a personal decision draw the line at age? Gender may be a complex issue, but it's also meaningless if each individual can determine it for himself (or herself, zerself). It's best then not to draft legislation that contains such useless terminology. The path back to sanity requires us to resurrect the idea of sex , an objective reality not open to interpretation. Should we fail to do this we will only slide further into madness.

During the pilot transition program with the KV-107 and C-130 with Lockheed, we found that most Saudi pilot trainees had very limited night vision, even on the brightest of moonlit nights. Their training retention rate was minimal including maintenance personnel. Some had dim memories and had to be constantly reminded of things that were told to them the day before. An American, British or any other western instructor is burned out pretty quick. It actually took Muslim C-130 pilots years before they could fly in the dark safely and then would be reluctant to leave the lights of a city. Ask any Marine, Air Force or Army guy who's been trying to train Iraqis,Saudis,Turks and especially Afghans. Islam is not only a religion; it's a way of life all the way around. Yet another set of revealing facts about Muslim beliefs and traditions and ways of life. 1400 years of inbreeding. I found this to be interesting. Didn't know whether to believe it or not. To research I went to Wikipedia, "Cousin Marriage", and far down in the article "Genetics" it seems there is a lot of truth here. A huge Muslim problem: Inbreeding Nikolai Sennels is a Danish psychologist who has done extensive research into a little-known problem in the Muslim world: the disastrous results of Muslim inbreeding brought about by the marriage of first cousins. Even in England , more than half of Pakistani immigrants are married to their first cousins, and in Denmark the number of inbred Pakistani immigrants is around 40%. The numbers are equally devastating in other important Muslim countries: 67% in Saudi Arabia , 64% in Jordan , and Kuwait , 63% in Sudan , 60% in Iraq , 54% in the United Arab Emirates and Qatar and 37% in Turkey. In Denmark , non-Western immigrants are more than 300 percent more likely to fail the intelligence test required for entrance into the Danish army. "A lower IQ, together with a religion that denounces critical thinking, surely makes it harder for many Muslims to have success in our high-tech knowledge societies." Only nine Muslims have ever won the Nobel Prize, and five of those were for the "Peace Prize." According to Nature magazine, Muslim countries produce just 10 percent of the world average when it comes to scientific research measured by articles per million inhabitants. In Denmark , Sennels' native country, Muslim children are grossly over represented among children with special needs. One-third of the budget for Danish schools is consumed by special education, and anywhere from 51% to 70% of retarded children with physical handicaps in Copenhagen have an immigrant background. Learning ability is severely affected as well. Studies indicated that 64% of schoolchildren with Arabic parents are still illiterate after 10 years in the Danish school system. The immigrant dropout rate in Danish high schools is twice that of the native-born. Mental illness is also a product. The closer the blood relative, the higher the risk of schizophrenic illness. The increased risk of insanity may explain why more than 40% of patients in Denmark 's biggest ward for clinically insane criminals have an immigrant background. The U.S. is not immune. According to Sennels, "One study based on 300,000 Americans shows that the majority of Muslims in the USA have a lower income, are less educated, and have worse jobs than the population as a whole." Sennels concludes: There is no doubt that the wide spread tradition of first cousin marriages among Muslims has harmed the gene pool among Muslims. Because Muslims' religious beliefs prohibit marrying non-Muslims and thus prevents them from adding fresh genetic material to their population, the genetic damage done to their gene pool since their prophet allowed first cousin marriages 1,400 years ago are most likely massive. This has produced overwhelming direct and indirect human and societal consequences. Bottom line: Islam is not simply a benign and morally equivalent alternative to the Judeo-Christian tradition. As Sennels points out, the first and biggest victims of Islam are Muslims. Simple Judeo-Christian compassion for Muslims and a common-sense desire to protect Western civilization from the ravages of Islam dictate a vigorous opposition to the spread of this dark and dangerous religion. These stark realities must be taken into account when we establish public polices dealing with immigration from Muslim countries and the building of mosques in the U.S. Let us hope the civilized West and the North Americans wake up before a blind naivet'e about the reality of Islam destroys what remains of our Judeo-Christian culture and our domestic tranquility.

Part 1: http://ift.tt/1PSiWdN 3. Lawyers Argue About the Facts Good lawyers always have long detailed initial meetings with their clients to understand the facts of what occurred. However, good lawyers also know from experience that the client's version of the facts is just that; the client's version of the facts. In almost all criminal cases, there are other different or even competing versions of the facts. It is always the case that there exists a truth about what actually occurred. However, it is obtaining that truth, and getting other people to accept that truth, that is often the problem. Sometimes people have different perceptions about what occurred. Also, some people lie about what happened. For example, it is often the case that physical force or deadly physical force is used to defend against the coordinated and threatening efforts of a group of people. In these cases, there are always at least two vastly different versions of events. Usually, there are several different versions of events. I routinely tell my clients not to be surprised when the person identified as the "victim" and all his or her friends have coordinated their versions of events to support an allegation of criminal conduct by my client. My clients are not usually surprised by this rather obvious prediction. When I start talking to the prosecutor in a criminal case, I always advocate for the best result for my client. This advocating normally focuses on my client's version of the facts. However, prosecutors routinely disagree with the facts as I present them. They almost always focus on the facts as related by the person identified as the "victim" or people associated with and friendly to the victim. As is always the case, the differing versions of the facts always lead to vastly different potential results for my client. We lawyers almost never argue about the law. If we have a disagreement about how the law applies, we can generally figure it out with a bit of legal research. Although you may invest lots of time learning about and studying the law, it is the facts we generally argue about; not the law. Indeed, this is the purpose of the jury. It is the jury that is charged with getting to the bottom of the facts of what occurred. They are given the law by the judge. I often advise clients that their case isn't about what actually happened. Their case is about what people will say happened as well as the physical evidence and reasonable inferences from that evidence. In many cases, the physical evidence does not resolve small but important or even conclusive details about what actually happened. It isn't enough to act consistently with the law. To be safe from prosecution, the evidence of what actually happened must also be clear to a police officer or a prosecutor. Remember, there is no doubt that innocent people actually get convicted in our justice system. In a dispute over the facts, most, if not all, prosecutors will afford the least credibility to the defendant. Remember, it is the defendant in a criminal case who usually has the most to lose and therefore the most invested in a particular version of events. As I stated previously, the person with the shiny badge is usually afforded the most credibility by the prosecutor and the jury. The "victim" of the alleged crime is usually the next most credible to these people. Whenever you think about pulling out your firearm, you need to consider both whether what you are doing will be considered reasonable by a random group of strangers as well as the real possibility that radically different versions of events may be presented to the police, the prosecutor and ultimately your jury. In keeping with the theme of this article, these reasons cut strongly in favor of being very conservative about pulling out your firearm. 4. Mandatory Minimum Sentences It used to be the case that sentencing judges had vast discretion in fashioning appropriate sentences based on the particular facts and circumstances of each case. This makes the most sense to me as judges are in a much better position than legislators are to fashion an appropriate sentence in a particular case with unique facts. In our ridiculously over-criminalized society, the trend over the past several decades has been to drastically diminish the judge's sentencing discretion in favor of more harsh, or even mandatory prison, "one size fits all" style sentences. Mandatory minimum sentences are generally those sentences where prison is required. In Arizona, all crimes involving the discharge, use or threatening exhibition of a firearm are mandatory prison offenses for those who are found guilty. As such, most gun related crimes carry the guarantee of prison time for those who are convicted; even for the first time offender. There is no possibility of probation for those who are found guilty. If you are ever prosecuted for a criminal charge resulting from a gun related incident, the odds are you are not going to trial. Regarding criminal cases generally, the vast majority are resolved with a plea bargain agreement rather than a jury trial. Depending on various factors, most estimates are over 95% of all criminal cases are resolved by plea instead of by jury trial. I strongly suspect the rate of plea-bargaining is even higher in cases involving mandatory minimum prison sentences. In short, because the risk of rolling the dice at trial is so incredibly high, the overwhelming vast majority of people will opt instead for the relative certainty of a plea bargain agreement. This vast majority of people undoubtedly includes people who may have ultimately been acquitted after a jury trial had they risked it. The bottom line here is that the risk of a long mandatory prison sentence upon a conviction often serves to coerce people out of their right to a jury trial. Prosecutors are well aware of this reality. I never officially offer any client better than 50% odds at trial. The truth is nobody can accurately predict what a jury will decide. Indeed, different juries sometimes reach different conclusions on the same facts. Trial is always a risk. However, imagine I could accurately offer a 90% chance of an acquittal after trial. In a mandatory prison case, that also means a 10% chance of a long mandatory prison sentence. When faced with a plea bargain offer to plead guilty to a lesser offense and receive a 100% guarantee of probation, I know from experience that most people will accept the plea offer; even with the hypothetical 90% chance of an acquittal at trial. Given this set of circumstances, few people will risk a trial in a gun-related case. Don't get me wrong. I enjoy trying cases, and it is generally my personal preference to go to trial. However, given that I don't have to personally suffer through the prison time if we lose, it isn't my decision. Some criminal defense attorneys would say that some prosecutors intentionally overcharge cases knowing the risk of trial will simply scare the defendant into accepting a plea offer. I have had many prosecutors cheerfully point out to me that the defendant's risk of a long prison sentence after a trial far exceeds the substantially lower risk contained in the pending plea offer. It is no secret that people who maintain their actual innocence sometimes plead guilty. Indeed, our United States Supreme Court specifically approved of the concept that there is no constitutional impediment to people who openly maintain their actual innocence from pleading guilty and accepting a plea offer for the purpose of limiting their risk. It happens in our criminal justice system. If you think you will simply explain this concept to a jury at trial, you would be wrong. The existence of a mandatory prison sentence upon conviction is a fact that is intentionally withheld from the jury at a trial. As an example, a jury may reasonably conclude that a 19-year-old kid with no prior convictions who sold $10.00 of marijuana (the amount he paid for it) on two occasions to his 19-year-old marijuana-smoking buddy would be looking at probation upon conviction. However, these facts require a mandatory prison sentence in Arizona. It is my experience that people give more thought to decisions they perceive to be very important than they do to routine less serious decisions. I suspect a jury would be much more concerned, and maybe even pay closer attention to the evidence or more rigidly hold the prosecutor to his or her burden of proof, if they knew the 19-year-old kid was guaranteed to go to prison upon conviction rather than get a slap on the wrist with counseling as they may otherwise reasonably conclude. If you are charged with a gun-related crime and plan to go to trial, you need to know the jury won't be told about the guaranteed prison sentence you will suffer if they find you guilty. Jury nullification was supposed to act as a final check on the government's power. Indeed, I would love to argue, with the right set of facts, that even though the peaceful homeowner was legally not permitted to discharge his or her firearm, the jury ought to acquit in any event as it was a close call and the home invader bad guy shouldn't be considered a victim. I suspect I could have success with that argument in the right case. However, the state of the law is that I am absolutely prohibited from asserting it. The case for being very conservative about pulling out your firearm is strong. The best way to avoid having to deal with the risk of a mandatory prison sentence is simply being smart enough to avoid doing the types of things which may give rise to criminal charges. Don't be an idiot with a gun! 5. What to Think About When You Are Thinking About Pulling it Out Given that self-defense is all about what's "reasonable," and that the facts of most criminal cases are almost always hotly contested, and keeping in mind that you will likely be facing a mandatory prison sentence if convicted, avoiding being charged with a gun crime ought to be of the utmost importance to gun owners. I'm sure you can see now why I advise people to be very conservative about pulling out their firearm. That said, there exists extraordinarily rare times when you must. Of course, my preference is that you call me in advance of pulling out your firearm. I expect I could be very helpful to you in determining whether pulling it out in your particular situation would likely be a violation of the law. I can offer you my best advice if you schedule some time to come into my law office and lay it all out for me in advance. I expect the appointment will likely need to be at least an hour and possibly longer. Even then, I'm likely to offer you an unsatisfying qualified answer to your question based upon some of the reasons I have already written about in this article. I would also mention to you that if you have time available to consult with me in advance of a decision to pull out your firearm, you absolutely shouldn't do it. The nature of an imminent threat is such that you simply don't have any time available to consult with anyone. It is a "right now" "right here" type of decision. If you are lucky, you may have a few seconds to think about it in advance. Fortunately, I believe you can do it with a simple analysis. I want you to imagine that if you decide to pull out your firearm, you will certainly be prosecuted for a serious felony gun crime. To truly understand this possibility, you must have already been arrested, charged and prosecuted for such a crime. Given that, if you have already been through such an ordeal, the odds are that you are now a prohibited possessor and can't possess firearms in any event. For those of you who haven't been through such an ordeal, I recommend you actually spend some time thinking about and actually visualizing what it would be like to be prosecuted for a serious gun crime. It usually starts with the arrest. The police will arrive and "escort you to the ground." I know it sounds good, but trust me on this one, you won't enjoy being escorted to the ground by the officer. Imagine the officer has already firmly concluded you are guilty of a serious gun crime. You will be treated accordingly as your new bracelets are harshly installed on your wrists. Hopefully, you will remember my advice and resist the strong urge to tell your version of events to the officer. After a miserable ride to the horribly overcrowded jail, you are booked in as the newest member of the highest incarcerated population on Earth. You should expect the judge, who has already read the officer's version of the case, the same officer who just cuffed and stuffed you, will set a very high bond to be posted in exchange for your release. As is now common, you may even be subjected to a cash only bond; making it much more difficult to actually post the bond and thereby secure your release. You will soon learn who your real friends are as they hopefully scramble to secure your release as well as a good criminal defense attorney. Although you are assured you are absolutely presumed innocent, you truly aren't feeling it as you choke down the disgusting slop served to you for dinner with your new friends at the jail. Even if you can secure your release from jail, you recall points #2, #3, and #4 above as a lawyer explains the serious felony charges now brought against you. Although I will be happy to zealously defend you against the criminal charges, I try not to work for free. In any event, any payment to any private lawyer is more than you wanted to spend. After possibly a year of misery, constantly wondering whether your life is ruined, you will face the difficult choices described above in the section on mandatory minimum sentences. Expect to be charged with a crime carrying a long mandatory prison sentence; probably 5-15 years assuming nobody died. Although you will feel strongly you withdrew your firearm consistently with the law, odds are you will eventually accept a plea offer; even if your lawyer enthusiastically wants to try the case before a jury. You won't likely accept the substantial risks associated with a trial when you are offered the certainty of a much more lenient plea bargain. As a final parting gift resulting from your unplanned interaction with the state, you are now a prohibited possessor; possibly forever. I realize I have intentionally presented, far from a worst case, but a very bad scenario for you to consider. Be advised, this general example is not far fetched at all. It happens all the time. My example is common. However, I also acknowledge that not all firearm brandishings or discharges are prosecuted. Indeed, not all people who pull out their firearm are even arrested. In my experience, I have witnessed good judgment by both the police and prosecutors. Sometimes, they are able to quickly sort out the good guys from the bad guys. That said, I want you to envision my exact example when you are thinking about pulling it out. If you are not willing to endure the rigors of being prosecuted as I have described it, my opinion is that the situation you face is not serious enough to warrant pulling out your firearm. Said another way, if what is about to imminently happen if you fail to pull out your firearm is worse than being prosecuted as I have described it, then I advise you to pull it out and act defensively. However, if being prosecuted as I have described it is worse than what happens if you fail to pull it out, I advise you not to pull it out. I will offer you some examples of the "Marc J. Victor Analysis" applied to some real life situations: Example #1 - If you fail to pull out your firearm right now, you are likely going to be dead. It seems to me that being dead is worse than being prosecuted. Therefore, I advise pulling out your firearm. Example #2 - If you fail to pull out your firearm right now, someone you love, or like a lot, will likely be dead. Again, I'd prefer to be prosecuted, so I advise pulling out the firearm. Example #3 - If you fail to pull out your firearm right now, you will likely be punched in the face. Although this is a tad bit more difficult, I'd prefer to be punched in the face rather than be prosecuted, so I advise not pulling out the firearm. Example #4 - If you fail to pull out your firearm right now, you are certainly going to be disrespected. It is important to note that this particular example is actually from a potential client who came to my law firm to consult with me about his aggravated assault felony criminal charge. He was facing a mandatory minimum sentence of 5-15 years in prison. When I asked him why he pulled his firearm out, he informed me he was disrespected by another person. I don't know about you, but I'd strongly prefer to be horribly disrespected on a regular basis than to be prosecuted. As such, I advise not pulling out the firearm in response to or even to prevent being disrespected. Dumb! I believe you can honestly and effectively perform the "Marc J. Victor Analysis" in a few seconds if you simply invest a little time thinking about being prosecuted as I have described it. I do not apologize for offering very conservative advice about pulling out your firearm. It is important to note that the law may actually allow you to pull out your firearm for situations far less serious than I recommend. For example, Arizona law allows a person to display a firearm defensively in response to an imminent threat of ordinary physical force. See, A.R.S. SS 13-421. I concede this law suggests a different conclusion for my example #3 above. Additionally, there are many other situations in which a person could arguably legally pull out a firearm than the "Marc J. Victor Analysis" would conclude. That notwithstanding, I firmly stand by my advice. There is always a risk of being prosecuted when you pull out your firearm. Ignoring that risk and assuming a police officer or a prosecutor will conclude your conduct fits nicely into a statute permitting you to use your firearm in the way the witnesses say you did, is foolish. Assuming the giant risk of being prosecuted only makes sense if what is going to happen otherwise is worse than being prosecuted. These circumstances are extremely rare. Just because the law may technically allow you to pull your firearm out doesn't mean you should. Whatever you are protecting with your firearm ought to be worth being prosecuted for. Random Thoughts To say I am pro-gun is truly not accurate. I am no more pro-gun than I am pro-hammer. They are both tools. I am pro-peaceful, responsible, competent adult with the option to own and carry guns. I am anti-idiot with guns. If you are short on common sense, you probably aren't someone who ought to have a gun. If you are hot tempered, quick to anger and act impulsively, I suspect you, and everyone else is better off if you don't own a gun. Owning a firearm is a serious undertaking. It comes with great responsibility. If you aren't up to it, don't own a gun as I suspect you are more likely to get in trouble with the gun than you are to actually need it for self-defense. I suggest you perform an honest self-evaluation before owning a firearm. I have been representing people charged with gun-related felonies for well over twenty years. I have noticed some patterns of conduct that seem to emerge regularly in these types of cases. I wanted to leave you with some random tips for preserving your freedom as a peaceful and responsible gun owner. Don't even think about mixing alcohol, marijuana or any other mind-altering drug with guns. If you are carrying your gun, you must be alert and have a clear head at all times. If this advice isn't obvious to you, I suggest you pass on owning a firearm. Secure your firearm carefully in your home at all times. Do not take any chances an unsupervised minor could get to your gun. You could be charged with the crime of felony child endangerment if you accidentally leave your gun sitting around while kids are present. People who pull guns out while they are driving down the road usually get charged with felonies. Prosecutors generally don't buy that the other vehicle was trying to run you off the road. If you find yourself involved in a road rage incident with another car, don't pull out your gun. Use your head and find another solution. I realize there may be actual tactical reasons to the contrary, but I recommend you do not carry your firearm with a round in the chamber. I have represented countless good people on accidental discharge cases. A purely accidental discharge in the city limits is generally a felony offense that carries mandatory prison. You should consider sacrificing whatever tactical advantage exists for not having to chamber a round in exchange for the much lower likelihood of an accidental discharge. Never use more force than is reasonably necessary to repel the threat. If merely displaying your firearm will suffice then do not point it. Always seek to use the least amount of force necessary. If a prosecutor sees you as a person just itching to use deadly force, doubts may be resolved against you in charging decisions. I urge you to act like a responsible adult at all times while carrying a firearm. If you plan to goof off, don't bring your gun. Although the law in Arizona does not require you to retreat, you should retreat if you can do so safely without risk to you or a loved one. Things can be replaced. People can't. The good guys don't always win. I strongly advise you to de-escalate a situation and even retreat if necessary to avoid a conflict. No, you don't get to shoot someone just because that person is trespassing in your home. Although I admit a shooting may be more likely to be justified because it occurs in your home, your actions must still be reasonable under the circumstances. Although there are indeed times when it is necessary, don't be in a hurry or too enthusiastic about shooting another human being. Conclusion As I said at the beginning, I do not intend this article to act as a substitute for carefully studying the law relating to firearms. However, I do intend this article to serve as a framework for better understanding the application of those laws in our criminal justice system. I hope you will be conservative about pulling out your firearm, and do so only in extreme and very serious circumstances. You would also be well served to actually become and stay familiar and competent with whatever firearm you choose. Having a firearm is close to worthless unless you can competently use it if necessary. There are countless people who regularly carry firearms safely and responsibly. Most of them will never have any problems at all relating to those firearms. Carrying a firearm ought to be boring. You should be comfortable with the fact that you will never likely have to pull it out. Like flood insurance, we hope to never need it. However, it is important to have in the event you actually need to use it. If you are carrying a firearm because you want some action, or you are constantly looking for reasons to pull it out, I suspect you will need my services someday. As I previously said, there are few ways to ruin the rest of your life more quickly than by misusing a firearm. I have seen it time and time again. I hope you will learn from the mistakes of others currently sitting in prison serving long sentences. Don't be an idiot with a gun! Marc J.
